Well, the original topic was the 'disadvantage' of oversubscribed v. other countries. What if we apply the same principal of equality of EB2 and EB3 applicants and remove these categories completely. I heard from a friend who has a brother working in one of the lawyers affiliated with the AILA that USCIS has issued an internal memo to "go slow" on all EB 3 petitions including EB 3 I. That is very confusing to me given that EB3 I is U on the May VB. Has anyone else heard about this? if so can the IV core take measures against this discriminitory move.
Well - at the end of the fiscal year - their goal is to exhaust the quota. They have to exhaust the quota and they figured out that they have old EB2 approvable cases. As long as they exhaust quota it literally means there is demand - there is nothing much we can do - we are just stuck.

I received an RFE too,but within 2 weeks of submission of my appln.I have already submitted the reuqested RFE.DO you know whats next?Is RFE a normal procedure?Is there any kind of risks,if you get an RFE?Please let me know.
I guess 13 days after the receipt of notice is a bit too long.I guess you should contact the INS ,incase your RFE notice has been lost or something.
Am quiet certain that an application will get approved even though there is a request for evidence provided you go through a good lawyer with the accurate documentation as requested by USCIS...

I am not arguing about who is ahead in the line to get the non-existent cake - please read my post once again and point it out to me where I said anything in such regard..
Frustration comes from the point that all the discussions take tone that all IV efforts are to help EB2 category alone. It is becoming frustrating for EB3s to keep reading posts and participating in actions when everyone keeps portraying IV effort as EB2 only effort.

By responding with who's ahead in line type of comment you both are just ignoring the situation that already exists as of today on this forum wrt EB categories. I'd venture to say that if at all you're making that feel of eb3 left out even worse than it already it.

As far as the lawsuit is concerned, just like all the other IV efforts, I'd gladly participate in it.

I think you can find a lot of people on the IIT forums that float around the web. Let's assume B entered into US on Jan 1st 2004 with Visa stamping Valid till June 2006.
B doesn't have payslips for period of 185 days(aggregate) in his whole stay in US , rest of the time he maintains legal status , but he never travels outside US and applies for his 485 in March 2006.
In this case B is under risk of illegal status for more than 180 days , as he never travelled outside US.
OK agreed , when it's a law we should abide by them.But what are the other options available for B? He can't be covered under 245(K) so this option is ruled out.He needs to forget about GC? Will it be helpful if he contacts good lawyer any hope? Or just rely on luck?

#3 Nov 2002 - Fall in love with an American girl
#4 Dec 2002 - Quit job and move to Michigan to be with girlfriend (Out of status)
#5 March 2003 - Find job in MI, employers lawyer botches my H1 transfer / extension (Out of status)
#6 October 2003 - Fall out with employer and quit.
#7 November 2003 - Marry girlfriend (Out of status)
#8 April 2004 - Wife files I-130/I-485/I-765 (AOS Pending status)
#9 April 2004 - Find a new employer "X" and start working for him

According to DHS statistics there are around 50,000 EB2 lndia Labors in 2004 and 2005 each. So ppl with 2005, 2006 priority dates you can wait around 6-7 years for ur priority dates to be current with annual limit of around 5000 for EB2 India.
The lawsuit can be filed by your American Civil Liberties Union Member or ur aunt or uncle or mistress who is a US citizen. U guys and gals with 485's will not be there in the lawsuit but will benefit if the lawsuit wins.
