My employer has job posting Bachelor's degree with 7 years of experience but does not say anything about Masters Degree. Wanted to know this job requirement fall under EB2 or EB3?. appreciate for the response.

If the new PWD guidelines were effective 01/01/10, then it shouldn't effect your PWD since it was filed on 12/30/09. You should try and find some document or FAQs to prove the same and send them to your lawyer. My guess is he might have messed up something in your process and is trying to cover it up with this story. Its better to have him re-start the process in that case because if he infact messed up something and he files your PERM, it could be potentially denied which will directly impact you...Try to find out if what he is saying is infact true (which I doubt), or if he is just mistaken..

No point in dreaming about getting any support from dems, they will bring up DREAM act for illegals and will hold legals hostage until CIR.

My AP is expired on December 9th 2008. I would like to renew my AP. Could you please provide the details on how to renew my AP? or Does it come as a new process instead of renewal?

It is indeed considered a renewal. And it costs something like $350.

I presently have a Nikon D100 which wife is beginning to use more and more....so I am thinking of purchasing another digital Nikon..........was thinking of getting the D70. However since I only need a body I was thinking of perhaps getting another D100 or maybe trading up from there. Any opinions offered would be appreciated.

Make sure you do not travel out of USA before you get your approved AP, since as per the law if the person who filled I485 leaves the country without AP then it is considered that he abandoned his I485, with the exception given to H1B/H4 and L1/L2 (and youdont have any of these)
If you leave USA without AP then you need to restart the process, if you have AP then that is all you need to travel.

My 6 year term of H1b is between 2004 Oct till 2010 Sep
My previously filed PERM & I-140 are under the verge of rejection due to a pending RFE.
I am planning to file another PERM. Even though I'm trying to do it ASAP, I'm wondering whether I have an advantage on filing new PERM before Dec 20th 2007.
While applying for H1B extension in Dec 2008, If I have an approved labor/pending I-140 I thought I could request for 3 year extension. If I don't have labor/I-140 pending I can only request for 20 months extension (as my 6 year H1B term ends on Sep 2010)
I read from a site that...
"One in H1B/H-4 status can extend to the end of the 6-year limit, and then take advantage of the provisions allowing extensions beyond the 6-year limitation, if the labor certification or I-140 was filed at least a year earlier."
When I asked this question to my attorney he said
You can file for an H-l B visa extension up to 6 years. You can only file for an extension past the 6th year if your labor certification and/or I-l40 was pending for more the 365 days prior to the 6th year on your H-lB Visa status. If not and your labor certification is approved and the I-l40 is pending then you can only request an extension in one (l) year increments only until a final decision is made.
So does this mean I can only request for a 12 month extension if labor/I-140 is pending on Nov 2008?

I had my stamping done in Delhi last year in September. They just asked me the following:
1. Latest Paystubs.
2. W2.
3. Client name.
4. My responsibilities at work.
5. How long have I worked at my employer.
All this took just a couple of mins. One of my friend also got his stamping done in Delhi in Dec last year.
Just carry all documents you can. They will not be needed, but you be more prepared and confident at the interview.

I came to US on F1 and am currently working on H1-B (never got H1 stamping) and I got married here in US. I applied for 485 as dependant with my spouse and I got my EAD/AP. I am still continuing on my H1-B without using EAD. We are planning to go to India in Dec and I prefer to use my AP while entering US and would like to continue working on my H1 (continue with same employer) after coming back.
