It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D
Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. But retaining the original timestamp in the regular queue is unacceptable to those who have qualified for EB2 before the one porting his/her date to EB2.

What is obvious is either you have been sleeping all thru or you are new to IV. Aman has made atleast 25-30 trips to DC in last18-20 months isnt it obvious that its a typo..

That is India time....
If you transfer less than 1000 USD to outside SBI, they will charge 25 rupees, the only problem is that they will not specify that charges any where in the transaction.....but it will be accurate all the time....
Just a correction SBI charges Rs. 25 for every transaction whether < 1000 or more.
Service charge of Rs.25/- (inclusive of Service Tax @ 12.36%) will be levied on every transaction where foreign currency conversion is carried out w.e.f. 16 May 2008.

Most of the people on Immigration Voice come here for legal advice regarding immigration, what if IV negotiates a good rate with 3-4 Immigration attorneys and recommends those attorneys to members? Attorneys would get business due to IV recommendation, IV will get referral fee ($100-$200) per referral and members will get discounted rates from good attorneys.

b) you don't do any benefit whatsoever to EB-3 India/China
c) you only benefit EB-2 India/China (at the expense of EB-3 ROW)
So, you make no difference whatsoever to huge number of EB-applicants (b), and you benefit (c) at the expense of (a).
I hope you see that this is not a good solution for the majority of EB-applicants. With this kind of cannibalization, the only people who have any incentive to stay with IV would be EB-2 India/China.
We have to work to increase the size of the pie here, and not engage in a zero sum game.

IV now has clout which should be immediately used for a permanent fix. Two issues which might not require laws being passed can be implemented to ease the backlog situation that will be created.
1. Recapture lost Visa numbers- A just and reasonable demand that they cannot refuse.
2. Remove per country cap- It is stupid to look for diversity in a category based on intellect. The whole category is created for improving America's brain power so a country cap does not make sense.
Which is better to say" We want 10 people with OK intellect from 10 different countries of the world" or " We want 10 absolutely brilliant people-period"
Supporting argument:
There is no country cap on H1/L1 work visa then why there is country cap for permanent residents.

The only chance that it happens is that visa overflow from other categories into EB2China/India...For that to happen..Eb3 world has to become current.....
That would mean that more visa are available than can be used for Rest of world...Then CHINA/India would get some more than 7% country quota....
So it could be Oct 07 or if you are lucky... earlier....
If immigration reform happens..you would definately become current immedialtely...

The question is none of the Admin fixes in last one year has helped EB3-I. In fact, it made our situation even worse.
it may look like it that it has made our situation worse. But it was never good to start with. The visa number flow was going to EB3-ROW. Now it is going to EB2-I. That is good since if EB2-I becomes current the flow would come to EB3-I as we have older PD people than EB3-ROW.
Nevertheless, EB3-I was always the last link in the chain and still is. Nothing has worsened or bettered. If anything can be good for us, it is the 5882 bill. Another thing that can help is removal of country quota. With so many EB2 people getting their GC, we are going to need to really work towards getting contributions for lobbying since the people who get the GC cannot be expected to help IV anymore. We always were at the bottom and are still at the bottom. We need to unite and work with IV so that we call can get what we want.

My PD is Nov 2004 (EB3 India). My 140 has not been approved yet. Also, I do not plan to use EAD so issues thereby are out of question. My only worry is can I keep renewing H1B while my 485 has not been approved. My attorney says NO. He says that you can apply for H1B extensions after 6 years only if you have not been able to apply for 485.
However based on your responses, it looks like I will have to validate this with some other lawyer to make sure if I can keep extending my H1B so I can maintain my wife's H4 status.
