I saw somewhere on other site clearly mentioned that once 485 is rejected, H1B extension based on pending 485 also becomes invalid. If a person keeps working, it it considered as illegal. I do not have link right now, but I guess I found it on some lawyers website, posted link on IV in some other thread.

So I am assuming we have a way to track who they are. Why don't we tag them - on the colored button on the top right, saying something like "xxx doesnot want to contribute but has posted 239 messages" and let people decide whether to read or ignore his message.

I received a sms saying that my case status has been updated (weird they sent it @ 9:25 pm PT). I was like here comes another biometrics appointment... but still let's check the status online. To my surprise and by god's grace, case status was changed to "Card/Document Production" (still cannot believe it). I dunno what triggered this but i did contact my Congressman yesterday. My wife's status has also changed to "decision" - should move to "Card production" soon.
My suggestion to all of you - please don't lose patience and do whatever you can from your end to expedite your case. It's your GC and you've to make sure you get it. Contact I/O, infopass and congressman/senator. Don't expect anything from your lawyers as they only care about money and it is in their best interest to see your case pending (more RFEs, EADs, APs, etc).
Thanks and all the best to all of you out there still waiting for your GC.

Why dont you call VFS and find out what's happening and if they can help you to resolve this?
The VFS website says the consulate is still holding the passport. My wife also applied for H1B on the sameday/sametime and she got her passport within 3 days. I doubt i am stuck because of this new PIMS rule. Should i send an e-mail to the consulate to confirm it?

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.
I wish everyone the best and hope they get GC very soon.

That is correct. Since H1-B petition is filed by employer, it can only be legally challenged by the employer only. Employee is beneficiary and therefore has very limited legal rights to challenge even if petition is denied.
Now, consider this hypothetical example, on practical note, if an employer files a legal suit, the employer must be able to defend his H1-B obligations for all its employees. That includes paying H1-B wages on "bench", H1-B worker working on sites specified by LCA, reporting to USCIS when H1-B worker resigns or is fired. This could be problematic for many small-time job-shops (aka body-shoppers).

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. Filter this out by talking to 4-5 different lawyers).

It is not just wife's work permit problem. If you don't have GC and your kids are entering the college, they are not eligible for any scholarships are student loans. So you have to bear all the expenses from your pocket or you have to take a personal loan at a higher interest from some financial institution

I have worked for some of the big Indian IT companies including HCL Technologies and Satyam and can tell you all that these companies are the most screwed up companies in terms of bringing in H1 and L1s from India and paying them peanuts for salaries. For example Satyam and TCS here in St Louis have a large outsourcing deal with Citigroup. There are about 50-60 Satyam Engineers here on H1 and L1 visas being paid around $45,000 per month+Benefits which is just about the Labor prevailing wage in this area.
Talk about rotten Desi companies and even the bigger players are not far behind in trying to suppress wages for Engineers and bending rules in lots of instances to bring in a flood of L1s/H1s from India to work on onsite projects.

All I have to say is .. do NOT bring parents or relatives to the US , period. Healthcare is pathetic and will rob you off tons of your hard-earned, precious savings. If you want to meet your parents/relatives, go to the home country but do not bring them here. I have heard far too many horror stories related to medical emergencies and the last thing I want is to put my parents in that kind of situation. In fact when my mother heard about the medical expenses here, she is terrifed to come here and wants me to come visit Pakistan instead, which I will gladly do.

Let me give this a shot:

Going by your id registration date, I am presuming you are new to this site and do not know the history of what transpired over the last few years. There are hundreds of threads/discussions/posts where these arguments have been made and answered. We (all of us) are seeing increased interest in solving our EB-GC problems because of hopeless retrogression and a ray of hope in terms of CIR. Just because one shows new interest, you cannot expect immediate consolation and agreement on what you say/propose.
There were numerous times when members felt a specific campaign and/or item needs to be pursued. Serious discussions happened and eventually the advice of core which gets its info from various sources supported or not. There is nothing to stop you or I from pursuing an option.
I for many months did not understand the rationale and the way the system/politics function in this country. I still do not understand. BUT I do understand certain basic things:
1. How laws are crafted: the process, the resources involved and other technical matters.
2. Lobbying and advocacy: What role they play when dealing with lawmaking. Go read about the healthcare bill and what is happening in the Congress, lobbying, interest groups, associations, ordinary citizens, PACs, non-partisan groups. you might get a taste of what this is all about.
3. Systems: USCIS, DOL, Homeland Security etc
4. Politics: The main parties involved (Dems, Republicans). Who reacts to what and what their core values are. What is left, middle, right. who is where.
5. How national and state politics matter.
I am going to generalize here a bit: A lot of members who get their info from CNN or Google Reader or other 'mainstream' media sources might get either a black or white version of news/happenings. I quickly realized there are numerous shades of gray when dealing with Washington DC. How politics of left, middle and right come into play, which Senator or representative votes which way and why, etc. Listening to a press conference and reading an article on CNN does not give one insight into politics. These are the 'backend' intelligence which I trust core to know and advice us. I do not expect them to reveal their sources nor specific tactics. Most often than not, there is a rational explanation.
In this specific case, my take is: AILA with all their nobel intentions are in the 'business' of making money from folks like us and our employers. There are many shades here and it is not all black or white as it may seem. Like a member pointed out, AILA does not represent just EB or legal immigration. There are other things involved which may be detrimental to us (you do not want to be bracketed in the same category as illegals or want amnesty as an example). Apart from this, timing is critical.
One of the most important parties apart from Lawmakers is our opponents. Anti-immigrants who wants to know tactics, strategy: who we are calling, whom we are faxing, whom we are meeting, how we work, etc. They doggedly follow and couteract many items. For every fax/call/email you send there might be a counter reply from anti-immigrants. When core suggests confidentiality and secrecy, those I believe are not some magic/secret cloakish things but a matter of pragmatic reality. That is the world we are in and to be successful, we have to deal with those realities.
Giving out updated information is not as simple as it seems. These are steps which can be easily retraced and antis can quickly use those steps and backstab us, crippling our efforts. Updated information == tactics. My last point is about: Donors Vs Non-donors. Do you know that you need not be a donor to volunteer ? Try getting in touch with folks at IV. There is a lot you can do and you seem to be the right person whom we need on our side. I urge you to contact IV.

Exactly my thoughts. However, that does not mean that I am not proud of heritage and culture of my country-of-origin.
The vast majority of people are here on these forums for getting their GC and USC.

If I am proud of my country of origin and its heritage then it must be absolutely impossible for me to entirely renounce and abjure all allegiance and fidelity with my country of origin. That is the expectation every human society or country generally have and must have to advance its own culture. Well I can not see myself fitting in that "Ethics watch" if I am changiing citizenship. If I am changing citizenship I absolutely do not have strong ethical connection with my heritage and country. And in that case it is fine to change citizenship for me and if I do that I would not speak about pride to my heritage and country. And if I am really and sincerely proud of my country of origin I would not become citizen of other country in spite of any attractive lure. It is that simple.

I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.

Yes a new memo was issued in 2009 (After DHS confirmed that they have worked with FBI to reduce the response time.) Now since FBI claims that 90/95% of the requests are happening within 6 months. DHS/USCIS is not allowing automatic approval of GC is FBI check was the only peice pending and was pending for more than 180 days.
