    IV is an open forum.. where immigrants like me can join and express views.

    IV is not paid for by just IV admins.. it is paid for by members and then members should be able to express views.

    What is wrong about stopping something that is unlawful and illegal?
    IF we are going to suppress free speech.. .. how are we different from a totalitarian regime?
    Infact, how are we better than a suppressive and divisive organization like numbersusa?

    It may take a masters/phd to be in EB2, but it does not take a masters/phd to understand what i am saying.... or does it?



    this is not a free speech issue, please dont trivialize the 1st amendment.
    You are allowed to express your views without fear of persecution, but the IV forum is maintained by IV admins and they have the right to delete whatever they want.
    Free speech means you can go start your own: oppose-interfile.org and no one will stop you. It does not mean that you can post whatever you want on any forum and people must leave it as-is.

    USCIS UPDATES COUNT OF FY 2008 H-1B CAP FILINGS
    WASHINGTON � U.S. Citizenship and Immigration Services (USCIS) announced an updated number of
    filings today as the counting of H-1B petitions received on April 2 and 3 continues. On April 3, USCIS
    announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year
    2008 (FY 2008) and that it would conduct a computer-generated random selection of cap-subject petitions
    filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
    As of April 9, USCIS has determined that approximately 119,193 of the H-1B petitions received on April 2
    and 3 are subject to the FY 2008 congressionally mandated cap.
    USCIS received on April 2 and 3 a total of approximately 12,989 cases requesting an exemption from the FY
    2008 H-1B cap because they were filed on behalf of aliens holding a master�s degree or higher from a U.S.
    institution. USCIS can now announce that the cap of 20,000 on these exempt cases remains open and that
    USCIS will continue to monitor these filings.
    USCIS will provide regular updates as the processing of FY 2008 H-1B cap cases continues.

    I didn't break the law knowingly, I did come here legally. I just happened to fall in love with someone and moved to her state. It's too bad it didn't work out, however I have maintained legal status after leaving the country and re-entering, back in '04. Look at the chronology.

    Please try to offer constructive criticism or information. If you don't have any, move on.

    I am on your side. This person seems to be a saint and talking about legal immigrants as if you are and illegal. He's an A**.

    I like your idea. And I do support it in spite I not being in similar situation.. However with a little bit experienece I have with similar work flow improvement projects I would like to point out that the impact on labour/cost has to be thought through. My understanding is the agency has not been using Visa numbers because they are heavily loaded. Now if you ask them to do this pre-adjudicataion for all cases that will impose a sever load on them. I may be completely wrong here - it could be another department, another agency so this may not be an issue at all.. but if possible think through this as we submit a proposal.. If needed (now gals and guys don't beat me up!) we could even pay them (So they could hire people) to get this pre-adjudication done?

    Comments, retorts welcome.. no abuses pls we are all learning here!

    This thread starts with a call to all the EB2 people. Is it only the EB2 people suffering due to USCIS actions? Or are EB2 applicants a distinguised lot that they dont want EB3 to join with them?

    It is so depressing to see the attitude of some of these guys !!! There have been so many threads explaining the difference(or indifference) between the qualifications of the applicants.

    The suffering has been equally bad or even much worse for the EB3 applicants. I am an EB3 2003 applicant and my suffering has been equally painful. The campaign should be about fair treatment to every applicant, not alone EB2 or EB3.

    Any campaign will only be successful when we try to do something together.
    If you yourself are belittling the EB3 applicants, why do you have higher expectations from the American Citizens/Government.

    Exactly.

    I wrote a letter to the university chancellor where I graduated from and urged him to use his power to influence lawmakers to pass STEM -or similar -bills or face the consequences in the form of dwindling enrollment of brilliant students. I used strong but not so harsh words. Refer to the following thread.

    My state chapter leader was also excited about this idea. I posted the letter and the chancellor's response on this forum only to motivate someone 'higher up' to read it, endorse it and make it an action item for everybody (with a US degree). I feel now that I did my part as a dedicated member but the IV leaders (those who have the authority in IV circle) failed to lead my initiative or take it to a higher level (may be I am not able to find better words here).

    Usually discussions get buried in forums. People open all sorts of threads and discuss - which is fine, but when some real effort is going on - I recommend the person who is behind it to own the effort. Thats what IV is - everyone MUST own the effort from start to finish and not give up or pass it on.

    It is difficult for people to spend the time and effort in a thankless job. And we all need a lot of motivation and courage to do things. We are all professionals and currently dealing with politics and bureaucracy - must understand how difficult it is.

    Below is for all readers

    I just read the messages from Aman and Pappu - their tone is understandable - they are definitely stressed because they have to deal with all this. Am sure they are definitely looking for committed individuals who can help them and who can be trusted. There must be more than 100% commitment to do what they are doing.
    Is it possible for everyone to commit themselves at that level?

    If not can people do the following at the least?
    (1) Provide correct information
    (2) Contribute monetarily
    (3) Join State chapter
    (4) balance their schedules and create some time for IV and do at least something
    (5) Stop crap talk and blame games and concentrate only on useful stuff
    (6) Contribute in any other way - publicity, convincing friends, coming up with innovative ideas .....
    (7) Channelize all your frustration into positive energy.

    Based on commitment, availability, skill, trust IV can definitely utilize your help in different levels, maybe ann admin, maybe a chapter lleader, maybe a chapter member , maybe a media coordinator ...... Do you have that in you? Are you willing to do it??

    I pledge $50 for this effort but I would also like to state that we should think before we move ahead, some items to consider are
    - Some one mentioned that we should try to leverage the press to get coverage for the response.
    - We should forward the response from USCIS to the president, first lady, ombudsman, Secretary of State etc
    - Get an exact understanding of what information would benefit us most and make sure we ask specifically for that
    - Try to negotiate a better rate with USCIC ;)

    Vldrao is not a god. His assumptions are based on the facts from USCIS data, Do you know that 22k visas were not issued. If yes,quote that. Nobody knows and all are playing guessing game. Leave him alone.
    Take it easy dude. Lets put it this way, do you know that 22K visas were USED? If yes, quote that.

    For me as one, I do NOT think 22K visas were used up in 21 calender days(ie approx 15 working days).

    As for as vld..is concerned, I wanted his input cause his GUESS seemed to be pretty accurate as the thing were going. So to say, chill.

    As per this $20 drive, I tried to contribute thru my Visa Card & it was "repeatedly" prompting card# enter is invalid...I checked/ensured expire date/secure code & info which I entered is correct but repeatedlly it was prompting same message...Anybody from IV can help whats wrong with the web page?

    I tried to submit my request 3 times, does it mean that I have contributed 3 times?

    That is because the country cap 7% and 5% for dependents is already satisfied for China/India....

    You have to understand the caps work in a complicated way..

    total EB cap 140K
    EB5 - 7.1% anything not used flows downward in the list..
    EB4 - 7.1% anything not used flows downward in the list
    EB1 - 28.6% anything not used flows downward in the list
    EB2 - 28.6% anything not used flows downward in the list
    EB3 - 28.6% nothing usually left...Anything left is not used ... Those are the unused numbers everyone wants to recpature....
    Schedule A Workers: Employment First, Second, and Third preference Schedule A applicants are entitled to up to 50,000 “recaptured” numbers. These are folks from medical occupations...nurses etc...

    In addition to this there is a country cap of 7% for principal and 5% for dependents..

    I like your idea of the poster. I sent letters and cards so far, but didnt get this idea that catches quick attention more easily. I support you.
    I will be doing some posters myself, one of them will be a scene of not buying a 300K house, just because USCIS is not clearing my case. I am really one of them, and I know there are many many more who pay roughly $1500/month on rents, but are just waiting for this mess to be cleared to be sure, before taking such a step. Show it such that the economy also benefits in our posters. Not just what they can do for us, but also what we can, in case they help us.

    All these happend to me on NWA and Lufthansa as well. It is just that day and time.

    I have worst experience flying Gulf Air. I have never again used that airline. They treat you like bad and only way to get your rights is to fight and create a scene which I cannot do so best option is to avoid that airline.

    I had recent experience with continental the flight got cancelled but the staff was good they immediately gave me tickets to Virgin Atlantic (which was earliest departure) but I had Advanced Parole and so could not take VA. Then I asked if I can get Qatar Airways and they did not ask any questions immediately booked me qatar. So my experience with continental at ticketing desk was awesome but the staff inside was not that great they were just Ok.

    I feel Qatar is the best airline to fly. I prefer that one for now.

    So please take a crack at how it works. Above posting is right from the horses mouth. As I challenged people if they think DOS/USCIS is breaking the law by going vertical instead of horizontal then they should contact them or sue them. However, no one has been willing to do this.


    In my opinion by 'Using the unused EB2 visa for EB3 ROW instead of EB2 India', USCIS is following the law as congress pased it...The law may be not fair but that is a different issue...If you want to change the law you have to get that done from the congress...suing USCIS would get you nowhere....

    In fact USCIS could do anything they want...They can let it flow vertically or horizontally...And they would have a good enough case in courts...

    Sir/Madam,

    On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration “services” provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

    We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS – a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us – “Case adjudication is based on receipt date” “No, we process applications based on notice date”, “Actually, it’s the processing date that determines which applications are adjusted.” !!!

    Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their “service” centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America’s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service – once applications are submitted to USCIS they disappear into a black hole. Barring a website where one can nominally check one’s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

    Another inconsistency, surfacing in August 2008, begs redressal – while I-485 applicants (albeit those from 2006 instead instead of earlier years) at the TSC were being approved in a steady stream, the NSC was almost completely inactive resulting in only a very few cases being approved prior to August 20th. After this date, the NSC appeared to completely hold off on all I-485 approvals while approvals continued at the TSC. Could somebody please account for this preferential treatment for I-485 applicants at the TSC versus those at the NSC? Furthermore, when complaint faxes were sent in to the NSC in protest, instead of issuing a formal statement to explain their approach, the NSC retaliated by issuing a bunch of RFEs. Is the USCIS trying to intimidate us so that we remain quiescent??

    While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled – we are bound to our sponsoring employer from the start to the end of an extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

    We request you to lend us your ear and address these issues so that we are not subjected to them in the future. Kindly note that there remain roughly 15 days until the October 2008 visa bulletin goes into affect. Once October arrives, the dates for Indian EB2 candidates retrogress to 2003. We believe you have the power to help a few more of us who have been waiting, seemingly endlessly, to get out of this immigration limbo.

    Do you think the visa numbers are over and that is the reason why they cannot allot visa number to you?

    My file is also in local office for the past 4 years and waiting for approval and not able to get any information at all. They keep saying extended back ground check that check and they lose files and it keeps on going with endless wait.

    Nobody was able to stop your Grandpa from hopping aboard the Mayflower and landing in Ellis island and making a good life for himself. He had the might. He did it. So will we. However, I will do one thing more than that. I will teach my grand kids to respect people, no matter who they are and where they are from.
