If you heard what the restrictionist lawmakers have said about what to do with illegals, this retrogression makes sense. The restrictionists want to make life miserable for illegals by making it difficult for them to get jobs, this way the illegals would go back on there own.
They are trying to do the same thing with us legals (without saying it aloud). If you are from India it will take you at least 6 to 8 years (if you are lucky) to get a green card. Frankly in the fast changing technologically advanced world how many people can hold on to the same job for 8 years straight, they cannot. People lose jobs because they are laid of, the company has run into bad times, the technology has changed and the company wants to move you to a different role or position etc, this way a lot of people have to switch jobs which invalidates thete green card process. They are making your life miserable so that you are broken down psychologically and finally will go away either on your own or because of some arcane rule, example the labor should be applied more than one year before h1 expiration etc, a living example is that Indian guy who posted recently that he is leaving US to work for Microsoft in Canada. This way they get the best of both worlds, you have young people in the prime of there life without any diseases who do not burden there medicare system, working hard and paying social security taxes and medicare taxes (which they will not get back) and in the end they are kicked out or go away on there own.
You got it right or what!!! That sounds like the modern definition of slavery and seems to be what is happening in US despite all the claims of abolishment of slavery. They just have refined it to a point where it is subtle and not so blatant.

update,
Called POJ today, explained that i have 2 I-140's, IO verified and said i am current and visa is available, took my I-140 number and sent an email to the floor. Dont know what floor means. She actually said "she is glad that i called". atleast now, she confirmed by Finger Prints which went to Vermont because receipt starts with EAC are back and uploaded into the system, namecheck is clear too...She took my A numbers from I-140 and I-485. Fingers crossed.
Will wait for this week to pass before i apply for AP renewal.

After we reported this news, we learned that there were some readers who gravely misunderstood the "final" rule making process. They were confused with the "proposed" rule making process. In the final rule making process, there is no comment period before the rule takes effect. On the date when the final rule is published in the federal register, it becomes a binding rule and the rule-making process is complete. Certain provisions in the final rule may take effect on certain specific later date or dates, but the rule itself becomes a binding law on the date of publication of the rule in the federal register. Accordingly, unless the DOL changed the proposed rule, substitution of the beneficiary of the labor certification will be eliminated on the date of publication which includes the substitution of the beneficiary in the pending labor certification by amendment as well as the substitution of the beneficiary in the approved labor certification. For those who filed the substitution I-140 petition, the proposed rule provided that only "substitution approved" on the date of publication of the rule would survive. Substitution approved can be interpreted to mean approval of the substitution I-140 petition. For the 45-day validity of the certified labor certification, under the proposed rule, the certified labor certification on the date of publication was supposed to have 45 days to file the I-140 petitions. For the labor certifications which are approved after publication of the final rule must file the I-140 petitions within 45 days from the date of certification.
The DOL could have changed part of the proposed rules in the final rule and the readers are cautioned to wait for the release of the final rule before they jump into any conclusion and take a misguided action.

There is a funding drive in this other thread towards reimbursing the administrative costs of IV.
http://immigrationvoice.org/forum/sh...ad.php?t=10708
Could you please pledge an amount ?
[QUOTE=eagerr2i]As Pappu mentioned, the $ 64,000 figure is not a typo. That indeed is the money that was spent by him individually. Logiclife and others made trips to DC,air travel, hotel etc.. does add up real fast. QUOTE]
This is amazing and hats off to you guys.
I am sure lots of people reading these kind of unbelievable recounts here and in the other threads have started contributing (including me). Are you guys getting any kind of numbers back from paypal, on what is the kind of spike that you are seeing in terms of # of people contributing in the last few weeks?
Has it gone up from say, 100 to 1000? or has the new IV crowd been apathetic so far? A feedback from the core will indicate on what kind of response we have been getting.
GO IV..
Cheers.

I see another question too on legal immigration...vote for that too..we need to bring forward legal immigration questions
Question on: Immigration
Illegal immigration has been a topic of heated debate and has received much needed attention during this election. In the midst of all the hype and bickering about ILLEGAL immigration, there is a group of people, often forgotten and ignored, who are caught up in a bureaucratic mess and yet are patiently waiting on the path to LEGAL immigration. This is a group of high skilled workers, most of whom have advanced degrees in medicine, engineering and science from Universities in the US. These people have obeyed all laws, worked hard, paid taxes and waited their turn, many for a decade, because of a system that is hopelessly broken and inefficient. I am one of these people and I have been in the US legally for 10 years and still years away from getting a green card. As the President of the United States how do you intend to address the problems faced by future Americans already living and working LEGALLY in the United States? Please note, this question is NOT about ILLEGAL immigration but about LEGAL immigration.

I think this is great idea EB3_NEPA. We need to work on this!!! A good interim solution. That way we can actually show the contribution that we can make to the society as a family. Does anyone have an idea where we can start?
How about sending letters to our representatives and then contacting the media on the plight of our spouses rather than on us!!! May be the human rights folks can help us on this.

cellpho, dont mind the hypocrites here. They are blinded by frustration and have lost their minds. In fact, at this rate, the time may not be far away when they decide to bid adieu
I understand the frustration. I was too, especially since I have been here for >16 yrs. and have completed my BS and MS here.
Frustration only gets you more frustrated. Anyway, let them scream....I consider this entertainment.

Yes it applies for IV too. We have a handful of monthly subscribers because everyone wants the other person to pay for it. If the problem needs to be solved, each victim needs to fight this problem.
Do let us know the outcome of your complaint.
Please also inform others how you went about making this complaint.
Filing the complaint is the easiest thing that I have done in a long time. As I had lots of written evidence so it took me close to 30 minutes to prepare the everything but normally it should take no more than 10 minutes. The DOL, Wage and Hour division, takes care of all the such complaints and the identity of the filer is kept confidential to the fullest extent provided by law.
The Form for instructions for filling the complaint & the form is available at http://www.dol.gov/esa/whd/forms/fts_wh4.htm list of H-1B willful violators is available at http://www.dol.gov/esa/whd/immigration/H1BWillfulViolator.htm and the list of debarred employer's is http://www.dol.gov/esa/whd/immigration/H1BDebarment.htm
When I filed a complaint, I sent the whole package via FedEx. I waited for few weeks to hear from DOL but when nothing happened I went to their office (they are few blocks away from me). I spoke with an investigator (who was very professional and courteous) who told me that even though FedEx shows the package was delivered they cannot locate it. The investigator asked me to resubmit the package which I did the next day. I received a letter from the DOL after 2 weeks saying my complaint has been received; they even assigned me a complaint number which I can use to track the progress of the complaint by calling their office. The DOL combined mine and my coworker's complaint together and assigned both of us the same complaint number; my coworker filed his complaint few days after I had filed mine.

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.
Without any reform, my guess is it is going to be 5+ years for my date to be current. Just wanted to hear a few other opinions.
Also, if there is any impending relief (like 485 filing by 2/15 thats being discussed), I would be interested in hearing about it. It would be terrible for me if I move and then a relief is passed immediately in the congress.
You can keep your PD if your 140 is approved from your current employer. I know of a person who did this succesfully.

I'm sure its a routine check as ur prev employer wudn't have notified USCIS that u have left them. Check with a popular attorney like Murthy or Khanna who may have come across such cases.

EAD & AP is luxury & aggressive. Keeping H1B active is being conservative and playing with probability and backup. It depends on your nature. Go for it!!
If you are planning on a big investment like buying a home or something like that. It is better to stay on H1B so you have a backup if something goes wrong with GC.
I have seen problems with cases using AC21 when they apply it asking for more details and also sometimes ur I-140 is revoked by your sponsoring employer and USCIS may trigger a NOID for you. Ofcoourse you can file MTR and prove that them that it is legitimate to change jobs using AC21, but if you have H1B also then you have a piece of mind.
Also for the first job change use AC21 and do H1B transfer also and see for 6 months so that USCIS is already aware that you ve changed company. You can address any RFE/NOID. But later on you are on ur own.
Okay I like the reply.
Big investments like house is another point to consider. Right. It is not easy to sell off your house and leave in case AOS is rejected.
I know it goes without saying that it is individual's choice whether to keep H1 or EAD/AP. As I said I want to know what Keeping H1 brings to the table.
