    Thanks for the detailed information.

I have a unique situation here. My original GC sponsor (a multi billion dollar industry leader) laid me off after 6 months of I485 due to lack of position in the company.

I ported my GC using AC 21 and joined another small consulting company. Now my GC is approved and I have an offer in hand from another company.

Will it be a good idea to move or do I have to wait for 6 months or 1 year before I make an employment switch.

My most important consideration is that there is chance of potential loss of job (may god forbid) with the current position. I may be able to save myself by switiching job right now. And of course there is more money on the table.

You are not with your sponsoring employer anyways, so take the new offer if you want. A piece of advice though, for such critical decisions, it is best to spend some money and consult an attorney, rather than muck about on IV and such. An hours consultation ( which all you should need), will cost you u2 may be 3 hundred dollars, but you will get proper advice.

Latest on this on Greg Siskind's blog...
"Some of you have been concerned about my post regarding the rejection of some applications received on July 2nd. I've been checking and it seems to be true that some cases were sent back that day. Apparently, the number of cases sent back is small, however, so that is good news. And you should have received the case back by now if you're in that group"

    WaldenPond,

Thanks for all the efforts you have made for us. Just contributed 200$ , please ask others to contribute too. Together we all need to give that one last giant push......

    Friends ,
I appeal to all of you, this is the best time to start enegizign ourself and contribute for the cause.... I have done my second contrbution ...let's do it..

    Hello anurakt,

Thank for contributing again to IV. You and other members like yourself would be the reason for IVs success in changing the flawed green card system.

Thank you for encouraging other IV members for contributing. As you know, this is very important and more amongst us should encourage our fellow IV members to contribute. Often times it is evident that few IV members are struggling to keep a positive tone on the forums. As you may have experienced, it is easy to post few messages here and there. The message of some of these posts is to throw out ideas for others to implement. But in the end, the success of our community will depend on the contribution from kind members like you. Thank You.

    Regards,
    WaldenPond

    Dear Friends,

Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"

    Our journey in short :

How long in US : 10+ years

First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
    Filed I140 and 485 - in July 2007

Since then I was enjoying EAD / AP with no complain .

I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.

    1. New Perm
    a. Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
    b. Requirement : 4 years Engineering + 5 years minimum experience

    2. EB2 I140 (TSC)
    a. Filed in March - Premium Processing
    b. My Lawyer sent interfiling letter along with I140 filing
    c. Approved in 7 days (A# and Priority Date retained)
    d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
    e. No email and no updates on USCIS website

Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

Wish you all the best ......to everyone who is waiting for GC.

    Thanks,
    Jimytomy

Congrats for getting GREEN CARD. Good to see another old PD (EB3) person getting greened. Looks like the upgrade route worked in your case.

    Wounds, here comes ................ salt!

There is no requirement in INA regarding the number of years in degree.

ImmInfo Newsletter: The Culture of No: More on the USCIS challenge of educational credentials (http://www.imminfo.com/News/Newsletter/2011-4-15/USCIS-challenge-credentials.html)

They are likely to lose, if litigated against.. just saying

It is not about 4 years degree But 16 years education to attain the degree.
Does anyone know recent EB2 approvals with B.Sc., B.Com degree from India (Even with M.Sc. , MBA, MCA etc). I thought they stopped approving such cases long back.

    $$$$$$$$$$$$$$$GOOD EVENING GC$$$$$$$$$$$$$$$$

    Deadline = April 30th, 2011
Goal = 5000 votes on survey (see I-485 filing w/o current PD thread) and momentum to continue with this campaign. The survey is a platform to gather and push for launching action items. Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.
Actions - 1) Vote on survey.
    2)Email ivcoordinator@gmail.com with PD, ph#,email & subject "I485 filing impacted,
3)Print/Circulate Fliers and spread FB, wiki link (see "support thread")

    Dear IV Members,

If you believe that your success depends on your immigration process - whether it's the ability to file I-485 earlier or to get green-card and citizenship sooner or whether it's the ability of your spouse to work - then you have to believe that your success somehow depends on the success of Immigration voice and these 170 volunteers in DC next week.
As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

For background click here -> Announcement about April 2011 Advocacy Days (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1901186-action-item-advocacy-days-in-washington-dc-in-april-2011-a.html#post2301599)
Contribute to Advocacy Event on the Capitol Hill (http://immigrationvoice.org/index.php?option=com_content&task=view&id=26&Itemid=44#onetimepaypal) (All one-time contributions will go towards organizing the Advocacy Days event)

Mr chaanakya, You may find this as a personal attack! But it is not. This is an attack on your thought process!

You claim that you received a PHD. But I seriously doubt whether the university that decorated you with a PHD evaluated your ability to think rationally and ability to reason!

Normally with education people achieve wisdom, knowledge, ability for rational thinking, ability to reason, humility, compassion and a better understanding of the functioning of the world.

I am not saying you do not have the right to complain or right to protest. You have and you definitely should have. But the approach that you have taken is the wrong one! In your post you criticize about people lamenting their plight! In reality, you are also doing the same, Am I correct?

If you are a real PHD, just go through the following post that you presented and analyze how you can improve that to make it a product from a REAL PHD!

If such an educated guy like you can become an opportunist, how you can expect higher standards from lesser mortals!

In another post you said that you were eligible for EB1 and couldn't go through that rout, are you lamenting here? If you are well qualified, why didn't you go through that rout?

    You said:

"You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job."

In the same token, Why you are not trying to achieve a suitable job at a suitable firm which will apply your GC in EB1? You have all the opportunities for that, right? Why can't you achieve a Nobel prize and obtain GC in a split second? Who is stopping you?

Just because, you did your masters and PHD from here, does that make you special? What about a guy who obtained Masters from G Britain? - Is he ineligible? Would you prefer special treatment over him? The point is, when you came here, you swore that you do not have any intention to immigrate, and you just have intentions to study and return to your home country - Try to remember, you did that in your F1 visa application form. So, my friend, nothing gives you a right to be here or to get GC. It is a privilege.

You need to understand one thing: Each person has different skills, living circumstances, responsibilities, and different type of blessing from the almighty. So, don't measure everyone with the same yard stick that you are using to measure and don't use your own selfmade standards.

If undocumented immigrants where also competing with you for a GC spot, you would have said, they also have the same opportunity here, why they are not taking masters and PHD to get their GCs sooner?

In reality, some are fortunate to reach your level, but not everyone! But that doesn't make them ineligible for the Pursuit of Happiness and Pursuit of a better life!

If you do have a real PHD, you should lead, you should be a role model for many and propel your energy in the positive direction instead of a stupid post like this! You can work to make things better in this country!

My point is, work hard and lead to improve the immigration related laws and procedures!

Last point I would like to mention: Dear friend, Just education alone will not make you a better person or a person with wisdom. Try to learn from life, lives of others, problems of others! I think, if you try, you can understand this better than me, because you have better education!

And please, don't speak for me: I am an EB2 Masters category guy.

Last message to all folks who express their feelings through red dots: Think before you act! Provide the real reason why you are giving a red dot. Don't just allow your emotions to control you.

Yes, that is right, I said “plight of EB2-India”.

I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

I am not working in permanent job. I am also in consulting job. I am not supporting the restrictions. I am giving comments. Some comments were not liked by some IV members and they are suspecting that I am anti immigrant from alipac or numbersusa. But I strongly suspect Indian bodyshoppers and consulting companies used big portion of H1bs, and that might be reason for those restrictions. Till 3 months before everything was going well and all of IV provisions were there in the skil bill and strive. But suddenly Durbin bill was introduced and just a few weeks back they sent a notice to Top most Indian companies about H1b. Whatever reply Indian companies give may create more trouble. So something went terriably wrong in past 3 months. Not even one pro legal immigrant amendment in Senate. I am not seeing anyone working seriously except IV. Immigration lawyers are more bothered about point system and family based immigration system.

that you have this marvelous full time job with an american company and are so very holier than thou...

btw i have a job like the one i described above, but preaching does not come naturally to all of us i guess.

i'd like to know if you care a crap about anyone whose life is likely to be severely shaken up by the things you propound here. remember they are simply innocent bystanders, they neither made laws, nor bent them. just tool jobs offered and did their work...

You mean EAD, not AP, right? AP can be used in conjunction with EAD.

Also, you can file for both EAD and AP and not use it. Just having the two will not force you to have 1 year extenstions. You can still get 3 year extensions if you don't use EAD and AP.

    Am I right, friends?

Based on my understanding once 485 is filed, one can only get one year H1b extension it does not matter if one uses EAD/AP.

Does USCIS send RFE for both primary & dependent applications, if it is related to Employment?

    Gurus, any advise.

If I understood your question right, are u asking about EVL RFE for both primary and dependent applicants?

I Don't think so. Logically even when the dependent works, the primary applicant's employer need to prove that they support GC process on that application.

They will not check for dependent EVL as it is not relevant in this case.
At the most they may verify dependent past non-immigrant visa status.

I think we should gather hundreds of thousands of people on H1B and waiting for greencard and rally together in Washington DC. Numbers does matter.
