The VFS website says the consulate is still holding the passport. My wife also applied for H1B on the sameday/sametime and she got her passport within 3 days. I doubt i am stuck because of this new PIMS rule. Should i send an e-mail to the consulate to confirm it?

In my opinion USCIS will not give inaccurate information, in writing, to a Senator. The letter clearly mentions 'Application Pending for India'...
USCIS might not have intentionally given any incorrect information. Perhaps to them what they sent means "EB applications pending for India". Key part is "for India", which quite likely does not mean chargeable to India.
I doubt if they can easily track out applications chargeable to India that easily (even if $5K is sent to them). Whatever is entered in the system when USCIS receives paper applications (e.g. name, address, date received, category, date I-140 approved, etc.) can only be used as a criteria for queries. Birth country perhaps is only on paper application, and is verified for approrpriate chargeability at adjudication time. Systems are not designed for handling cases where country of chargeability is, as is the case for us, the final stopper.

Longest I have seen a 485 denial go without getting reopened is 5 months.
If a person doesn't have h-1b then six months is a magic number. If person overstys six months and uscis ultimately denies it again then person is in terrible situation (3 year bar).

how can i talk to those knowledgeble service reps from the service center. can you please suggest me how i can get to them, i have been trying to talk to them since morning and i could not get beyond the first service rep. any tips on how to get to them
Simple : tell them u have applied and its been more than 3 weeks and no response yet and tell them that last week they asked to call back so that they can forward to other cs reps of service centers

We have seen that even after the PD being current, there have been many people whose cases have not been approved. We saw last year in July many cases with later priority date and later receipt dates were approved and people with earlier PD and earlier Receipt dates still waiting,
Now with the 180 day rule for FBI name check, things could be expected to be little better, but we have to remember that since most of the cases are paper based, some one has to physically get to cases from a huge storage, sort it manually, distribute it manually and get it adjudicated.
So even if the visa number is current, just beacuse the number of applications are so high that we still cannot say for sure whose cases are going to be approved.
From www.immigration-information.com, it appears, the biggest factor in getting the GC visa number allocated to a case is, having a case ready to be adjudicated and in the hands of an immigration officer at a time, when both processing date and priority dates are current. It appears that even after the huge retrogression, there were not enough demand for AOS based approvals, so they had to PD current to allow CP based cases to use the visas and ensure they are not wasted. I like the fact that visa were at least not wasted, but I would have loved to see applicants who have been waiting for years to have a first opportunity to that visa, specially because they have done everything that any one could do.
I have been pro-fee increase by USCIS, only provided that they will use this money to expedite the processing, make things eletronic, make things more transparent, and to be honest, I feel the overall improvements are happening. Though I still see a lot of scope for futher improvements.
We have clearly seen that labor processing has been improved dramatically with PERM. Now waiting for years to get Labor is almost history. I hope that IV and all its members direct its efforts towards ensuring that we see the improvements in efficiency that we expected to happen with fee increases.
Lets unite together to work for a system which is fair and efficient for everyone. Lets contribute to IV administrative fixes and any other efforts which will ensure a higher efficiency and better utilization of visa numbers for AOS applications.

update,
Called POJ today, explained that i have 2 I-140's, IO verified and said i am current and visa is available, took my I-140 number and sent an email to the floor. Dont know what floor means. She actually said "she is glad that i called". atleast now, she confirmed by Finger Prints which went to Vermont because receipt starts with EAC are back and uploaded into the system, namecheck is clear too...She took my A numbers from I-140 and I-485. Fingers crossed.
Will wait for this week to pass before i apply for AP renewal.

I had called the congressman from my district (Peter Visclosky) along with the other representatives on the list a few weeks ago. His office had taken my name and address at that time. Today I was surprised to see a letter in mail regarding that conversation and his intention to support the immigration bills in house. So it looks like that the messages we leave with congressional staffers who attend the phones do pass on the message to congressmen.

Oh yeah .. but that is provided I can file my 485 by that time. Given my PD was just May 06, I had NO preparation for 485 filing, wonder how much time gathering up all the required docs takes for this filing :)

Any of the guys who got these LUDs , was your 485 application transferred from say Vermont or CA to TSC or NSC and if so, did the Transfer Notice have a different Receipt date ?
Everyone who got these LUDs(because of pre=adjudication) has a Receipt date which is in line with the Service Center's Processing timeframe.
During the July fiasco, they were moving applications around so that they can receipt them faster.
The reason I ask is, my 485 receipt date from Vermont is 7/29/07. Then it was transferred to TSC and the Transfer Notice had a receipt date of 10/1/2007. I am wondering which receipt date they'd consider.
Anxious because I had a Change of address (200 miles) and so expecting a RFE.

Hi I am a physician in Oregon and my parents are visiting too in July. I called Kaiser regarding this, and this is what I was told.
1. they can get insurance since Kaiser does not need an SSN for the application.
2. Every Plan has a deductible $, an out of pocket maximum $, and a co-insurance $ amount.
So,
Plan A: Deductible 2500, Co-insurance 22% of all inpatient cost upto max of $22,000.
Plan B: Deductible 6000, Co-insurance 50% of all inpatient cost upto max of $50,000.
Essentially none of these plans are a 'good deal'. But remember its easier to pay back a loan of 22k - 50k than to pay back 100-200k.
Also since Kaiser is an HMO, and has its own facilities in the west coast and Hawaii, 'accepting insurance' is not a problem.
