This is completly wrong statement. Actually, it is otherway. The EB3-ROW is currently enjoying at the expense of EB2-India and China. It is enjoying not only in this year. It is happening since 2005. If you have doubt, please visit DOS website and anayze the statistics right from 1999 to 2005. Furthermore, all the AC21 numbers (about 150,000 unused visas) that was captured in previous years (1999-2001) that came from unused EB2 and EB1 numbers. Theoritcally, these numbers should have been used to reduce backlog in EB2 first, then it should go to EB3. Since no one cared about this, EB3-ROW was free riding in EB2 numbers despite heavy demand in EB2.
Everyone knows that EB3 is heavily retrogressed compare to EB2. No doubt about that. The only solution for this is to increse the numbers. Everyone is working hard. However, it does not mean that one should ignore how DOS/USCIS mis-interpertinng the law and doing harm to EB2 Indians and Chinese. No one here is to sacrifice for EB3-ROW. I like the idea of an annual $100 fee to join.. that way all members have contributed.

If there are 25k members and your funding drive is for $30k, why don't you accept $5 and $10 donations?.. Why only $100 or above?.. With 25k members, if we start a drive to donate $1 / member and only 1 in 10 respond, you will reach your funding goal.

Did you guys paid attention to this, when Inflation rose to 13% Indian Finance Minister said it is because Oil is at $160 a barrel, but now as Oil has come down, Inflation has come down worldwide Inflation is still above 12% in India. also, when Stock markets were at 22K Indian FM minister used to give Interviews every day it is because of great policies of UPA govt. Now Sensex has slashed 40%, Finance Mn. has suddenly dissapeared. Did you guys also heard him saying 'Indian economy is insulated from ongoing US crisis'. Could we keep calling, even after raising one SR?
Raised an SR on 08/25/2009. Took infopass on 09/02/2009 and came to know that mine, spose and the kid got pre-approved.
Recd a response for my SR on 09/04/2009 from uscis saying that my case is being actively processed. Called uscis again on 09/04/2009 and got good scoldings from the 2nd level CSR saying in a rude and harsh tone, that I have already raised an SR and am supposed to wait atleast for 60 days before calling again.
Could I still persevere and call uscis? I was never so anxiuos or dissappointed before at not getting email.
Actually, I thought what the heck and tried it from my personal email. And they responded in 2 days. The response was all BS...full of grammatical and factual errors with strange sentence constructions...seemed to have been texted by a highschooler.
What actually worked was POJ method of reaching NSC IO.
9/3/09: IO was curt, but I insisted on assigning my case to an IO.
9/4/09: IO was all sweet and honey...told me that my case had already been assigned to an IO because of my call the previous day. (This is important, folks - getting your case assigned to an IO). She was so approachable, I asked her if she could approve my case now. She obviously said no, but said she would see what she could do. This was the best response from NSC so far. Asked me to wait for one more day. It was long weekend, so had to wait 3 looooong days.
9/8/09: IO gave the approval news. 5 minutes later, my wife called and got a really annoying IO, who instead of looking up her case, went on a tirade. That night got the email.
9/14/09: Got the card.
I did try 2 Senator's office, a really hopeless CongressWoman, both Obamas, both Bidens, Napolitano, Mayorkas, Pelosi, Ombudsman, two NCSC SRs, AILA (through my attorney). And nothing worked. It was funny that the Senator's office called me to wait 60 more days. When I told her of my approval, she was short with me. So, in my case, nothing worked except the POJ method and personal perseverance. Keep on calling until you find a good IO to help you. Good luck!

I have a question. My Firm is a really small one, just 1 employer + my = 2. The tax returns are not so good, becouse all the money was invested in a second business. The firm started in June 2005. The Firm has ca. $65.000 in a saving account. My salary will be $2000/month. Will be enough this $65.000 for the USCIS, for the Ability to pay.

1 week after getting approved, I got the card in mail today.
All the work that I put in the last 2 month to get my file picked finally comes to an end here. It's good to see that people are proactively calling USCIS and following up on their cases.
Good luck to all EB2 folks who are current and waiting and to all the EB3 folks, hope you guys become current soon.

"You can come to office at 9:00AM and leave by 6:00PM. No body asks you to stay late unless you work for a consultant. No body asks you to relocate unless you again work for a consultant." .
Yes you can do that. But you work late coz people Not dependant on H1B's can leave on their scheduled times coz if they get laid off, they wont be deported if they dont get a job in 10 days. Sure there is No Formal distinction on paper between H1B's and Non H1Bs, but it is assumed that since ur application depends on the employer (entirely), you will put urself to the grind.
You could easily get a legal immigration if you opt an easier path 'Marry a local'. So, again you have opted a hard way of going through labor certs, I-140, I-48 etc.
What about people who come here already married? Now for those unmarried you have to marry a Citizen to get a Green card. Marriage is a totally seperate thing and is not something that should be used solely for getting a GC (IMHO). Sorry but i do not agree that marrying a citizen is an easier way of doing ur immigration.

I am married too, but i only said that there are other easier paths aswell.
Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.
I don't know, if we are deviating from our main discussion agenda started by LogicLife.

My PERM application (5/28/07 PD) stuck at Atlanta
In meantime I asked my lawyer what my employer would need to get for me (my employer has been a major pain and slow beyond words...took years to get PERm going...i'm seriously just done/depressed with so much). My lawyer said they would need to provide 2006 tax docs and sign bunch of papers etc.
Checked with employer...it's an average work place...must have 100 employees i think....and i'm told by HR (this woman in charge seriously has some stuff against me...i don't know) that they don't have 2006 returns, just 2005...come on a legal place like them has to have filed 2006 return.... but this is what i'm told..
I guess what's the point...without those docs, which i assume are initial evidence, i have no hope....
me...really sad....

Don't worry about what feedback people gave you. People are jealous of you. Understandbly so, because of dates going back all the time. You deserve what you got and you got what you deserve (I mean the citizenship and not the lousy feedback no one should care abt). You have pretty good educational background too.

Today I have seen soft lud on my 485 application, My pd is dec06 eb2-India, I have called uscis IO she updated my address and she told me that they are waiting for visa number once visa number is available they are working on my case, I asked her why I got soft LUD, she replied that IO opened my file and find out that country VISA number is not available. Because they touch my file I got soft LUd.

It may not be popular here, but IMHO PD porting within the same filing category can be allowed, but not retaining the same PD if you are "upgrading" to another category.
I remember one person giving an analogy of a queue in a grocery store. I would like to give a different take on it. One express line and another regular line. Lets say the regular line moves real slow and the express line is well express. However the express line slows down, but is not as slow as the regular line. The person waiting in a regular line decides enough is enough, moves to express line (by dumping the items that exceed the express line limit).
How would the people in the express line react if the person from the regular line tries to "retain" his or her position by cutting into the express line, stating that he/she was before them, but only in a different line?
If you think logically, that is the case we have here with category interfiling.
I would recommend some sort of compromise, as its not fair either to ask EB3 people to move to the end of queue, as all said and done they've been able to bargain with their employer to apply for their GC, while we did enjoy a bit in grad school, and came out with a sense of entitlement. :D
Some intermediary date, lets say determined by a mathematical algorithm (hopefully not designed by gctest) or whatever is deemed to be a fair date. But retaining the original timestamp in the regular queue is unacceptable to those who have qualified for EB2 before the one porting his/her date to EB2.
I think USCIS must meet the EB convertors somewhere mid-way to maintain fairness.
About gctest, what has pissed me off so consistently is his trash-talk, calling EB3 third grade workers, his utterly self-centered attitude and inability to see other side of the story. Over and above that he lies, cheats and changes his story all the time.

How many are actually converting?

handful people actually converting due to risks involved.
