Hi Gurus,
I need an advice from you.
The situation:
-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

What is the lawsuit about? Is it by the insurance company suspecting some kind of scam?
In any case, you must defend yourself. If you just run away, then you might find yourself in 3 million dollar debt and all your assets frozen, even in India (assuming you are not planning to live the life of a fugitive!).

How can we figure out the net assets from a 1120S tax return? I have the copy of company tax return with me and I am "accounting challenged". Can some one please help me figure out the net assets, so that I can answer my ability to pay RFE.

Company tax returns can only show the NET INCOME . You need an Audited Financial Statement prepared by a CPA to show NET ASSETS

Nitin, how do you think that people who are here in this forum does not know about the other options available? Where in this world you get as many opportunities as you get in USA? Where can you get the flexible life like here?
How many IT jobs are there in Canada (assuming most of the members in IV are into IT)? Canada Alberta program increased processing times to 8 months now and it excludes federal processing times. Federal application method takes more than one and half years.
So its good that you have chosen an alternative and worked out well, but your alternative many not be an alternative or not even option to all!!!

No.... USCIS is not dumb...They have interpreted the law in the way they think is appropriate....They are applying the over all 7% country cap to China/India EB2 and sending the overflow to EB3 ROW..... It is not fair but it is not exactly illegal...The law is open to interpretation and USCIS has chose to select this interpretation......You can take a crack at suing the USCIS.....I doubt that you would get anywhere......The EB2 India/China might benefit from the lawsuit....But as you know not all members would agree on IV spending resources on this lawsuit because this serves only a small section of member population.... At a personal level you can gather a few EB2 China India guys and have a crack at suing USCIS....

I was incorrectly equating personal actions and beliefs with IV's actions and goals. I apologize for that.
First of all, my action just represents myself, not IV. Secondly, I don't really care whether EB-3 ROW would quit or join IV. To be frank with you, my PD is just 3 month away from the current date (EB2 China). From what I know now, immigration reform won't reduce my waiting time significantly. I have contributed to this organization, but now I decide to take some action of my own instead of contribute to this organization. It's quite funny that you threaten to quit this organization. This organization would benefit you much more than people like me since you are in EB3 ROW. But it is totally your call. I don't care whether you quit or not.

My wife went for H4 visa on Dec 19. I booked flight ticket on 28th. So it seems like I need to postpone the date by at least a week.

Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Not sure about you, but a lot of the people enrolled into the doctorate program in the 2001-2004 time-frame out of necessity. They could not find a job after their masters and decided to go for the quals as a fallback. If you did actual research, you should have enough publications and acclaimed research to get you into EB1. If not, well then there's no need to cry in self pity here because you are getting exactly what you deserve.

1. As for as I can see the 45-day rule comes in to force only after the rule is published in federal register. So all LCs approved after this publication will have 45days of life and has to be used by the original applicant. It's still a grey area as to how LCs approved before the rule publication will be affected. From immigration-law.com, my understanding is that all the LCs approved before this publication will have 45 days from the date of publication and if the I140 is not filed by then they'll expire. So all LCs approved so far will have 45days from the date of publication. Now to Labor sub.
2. Substitution of labor can be done by 2 methods
a. by amending the existing labor certification before approval
b. by substituting after approval.
3. When u do either 2.a or 2.b DoL stamps a substitution approved stamp on the LC.
4. If you are doing a labor sub and u fail to get this stamp before the rules goes in to effect then ur lab sub will be automatically rejected.
5. If your labor sub is approved before the rule is published in the federal registrar then u go ahead and file I140.
