Advantages of EAD far outweigh the disadvantages. Unmarried individuals of PD 02,03,04(eb3) might have a reason to worry but not the rest.

I understand DREAM act is not related to EB issues. What I meant was, just like how DREAM act is being added to an unrelated bill, we should work on adding things like 'unlimited STEM visas' and 'recapture unused numbers' to other bills and get them passed.
IV core will need lot of support to do accomplish this, hope at least some of the folks who got into IV because of the july fiasco contribute funds.

What I really wanna know is how Grassley will react to a H1 visa blackout in April 2008.
If he fails to get his $5k tax hike before April and H1 blackout in the first day as expected, then it just adds fuel to the fire - he will rev up his war-drums again. But if he gets his way and H1 blackout anyway (if not in the first day then soon due to pre-existing demand from 2/3 of the applicants who lost the lottery last year), then he looks like a total a**!!
Maybe it's in his best interest to not touch H1 before then. I mean this must be why he was rambling about how he could be willing to increase caps if he gets his tax hikes...

Not so fast...the bill language clearly indicates that the provisions of this bill will take effect from the first fiscal day of the new fiscal year after this bill becomes an act...so unless this bill is voted by the house and senate and then signed by the President before September 30th, we will not be seeing any benefit until the fiscal year starting October 1st, 2009. After the September session, Congress will convene again in November/December timeframe for a short session. If the bill does not get passed then, then come next January, it will be starting the process all over again as it will be a new year for the Congress. Just like green cards, Congress does not carry over bills from one year to the next.

The only way to counter this is to get our story out in the media. i joined the forum today and went through a lot of mails on the forum. i saw pappu making appeals to members to help him write to reporters. I saw state chapter threads and only few members have actually signed up for work. see only a handful responded. others simply come on forums and rant. but only few actually do the work. I also observed members critical of Iv or telling IV to do this or that, instead of doing something themselves. My other observation is that members do not contribute money and come to this forum for free advice. Nothing in this country is free but IV is providing this forum and also free advice from lawyers. But members are simply taking advantage of IV and not paying back what they are getting from it. This has been my personal observation. Members we have seen how visa bulletins affect us and demoraliize us. why dont we all do something instead!

I would rather have 10,000 members paying $100/year (that's *less than $25/month, btw... :) ), than 25,000 forum browsers... no offense meant.
For those comparing IV with free web-based services like Google/Yahoo/Hotmail/others.... you probably don't grasp the idea behind IV, and this is precisely one of the reasons why a membership-based organization is desirable... :
- IV is no gmail or hotmail
- We don't get advertising revenue,
- Nor have we gone IPO like Google/Microsoft/Yahoo (neither can we... :)
- Nor are we funded by wealthy VCs
- Nor is this a "business model"
- and Nor do Google/Microsoft/Yahoo care about your immigration woes... .
Bottomline - we're not a business, we're a non-profit organization - that needs funds for operations and lobbying efforts. There are normal operational needs that are taken care of by membership dues in most organizations. There are special one-time needs that are taken care of by funding drives.
So let's rise up above this madness...

Whether to remain in H1b status is a personal choice. There are a lot of considerations in this. Whether you want to change employers, whether you want to take on an extra job, whether your spouse wishes to move from H4 to EAD and get a job. How shaky your job situation and petition are.
Generally however, if you have had your 140 approved, have your receipt notices and have gone through the fingerprinting/security checks and it has been a long time pending where it is likely your 485 has been through the initial internal processing, then punishing yourself by not availing yourself of the relative employment freedom that the EAD offers might be considered too timid. However, that is just a view, it is essentially an individual choice based on your circumstances. Many people often stay in the H1 status until it expires if things are going OK, as not "rocking the boat" seems like the path of least resistance in times of uncertainty. When the time comes for H1b renewal however, other issues like, cost, waiting time etc come into play, and I have seen many people then choosing to just go with EAD/AP which as someone pointed out they often have already. Then as time passes, they figure, oh well since I'm on EAD/AP already I might as well go for another similar job. As months and years go by in this 485 limbo, these type of choices become more and more necessary.
Then you hear about issues like this and you wonder whether EAD means anything in this country and feel H1b might be better.

Once congress is adjourned for the year and end of year appropriation bills are completed, not much is likely to happen before 2009 summer at the earliest, implying 2010 by implementation. That said, perhaps this should weigh into considerations as well, I mean 2 1/2 more yrs is a big deal and may be worth the small risk.
Of course we all hope for something before that, however we also need to be realistic and see that this retrogression monster hit in 2005 and 2 1/2 yrs later we have got no proper fix to the retrogression issue, more awareness yes, but the political climate is very difficult.

Yes amitjoey. thanks a lot for that help. I wish more people participated in it. infact if more members can continue to do it today it will be very helpful. yesterday there were at least 3 mails from reporters expressing interest in us. This was because a few people wrote to them about IV and requested them to do a followup article abut us. I had found about 72 articles yesterday morning and we had more than 50 potential reporters to contact.It is not easy to get press coverage and this is one opportunity where we can captitalize on the venture captitalist story (no pun intentended).
Can we know names of these reporters who wanted to know about us? Also, is there any update on what QGA is doing on getting the word out about IV to the lawmakers? In her response to me, Clinton did not appear to indicate any knowledge of the severity of the problem that legal immigrants are facing due to retrogression.

I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

So I am assuming we have a way to track who they are. Why don't we tag them - on the colored button on the top right, saying something like "xxx doesnot want to contribute but has posted 239 messages" and let people decide whether to read or ignore his message.
