how long after the soft LUDs did you get the hard LUD (RFE)?
And what was the RFE for?
I had a soft LUD on 3/19/09.
Nothing has happened since.

Same here. Applied for AP. Got a soft LUD on my I-485 on Mar 25, 2009, got my AP approved on Mar 26, 2009. Does this mean they checked my 485 application prior approving my AP? or are they pre-adjucating my application? Will wait for a week or 2 to see if i receive any RFEs.
My PD is EB-3 I, Mar 2004 and no way closer to being current.

I'm itching to finish my 6 months on EAD to change job..
Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.

Wife and I attended H1 visa interview on Dec'13th, I got passport in 1 week, haven't received passport for wife. Consular staff very rude, say her petition details are not in their system so have to wait. They hang up phone as we are following up everyday. They say 4-5 days everytime we call them

My wife and I also had soft Luds in February. Nothing for me but got a Medical RFE for my wife. We sent back the response and the case has resumed processing.

Yesterday, I got RFE for myself and my husband and need to respond by April 29th.
On my husband's 485 application we entered Last Entry Date wrong, they asked for the proof for the same and all I-797 issued to him so far. We have all his I-797 approvals and he was never out of status, but just worried that we put wrong date for Last entry Date.
I have sent the RFE to my attorney, waiting to hear his response. I am really worried what it could mean, not sure if it is a big thing or a simple RFE, need your advice.

I think you guys are organizing a watershed event for skilled, legal immigrants - I wish you great success.
I cannot emphasize the importance of alerting media to this. Media attention is not at its best over the weekend so you will have to work extra hard to make sure that you get good media coverage. I hope that someone is working on creating a press release for the event.
While we were creating the press release for the flower campaign, we were given the following advice by a friendly journalist
Make sure that you have a catchy slogan and title for your press release and the event
Don't let your press release be a big mass of text. Break it down into What, Where, When and Why (refer to flower campaign PR if you need to)
In the media contact, absolutely have at least one contact with cell phone number and name. It is important that journalists can all and talk to a person if needed

-AILA and others had been and are are still trying to oppose this rule as it benefits them and their clients (employers).
-Labor substitution has been abused and has given a bad name to the GC process.
- Lot of desi companies have become notorious for selling it. Some of them were brave enough to sell it online on sites. Iv condemns any kind of misuse of the system and breaking of law.
- A lot of labor certifications coming out of BECs continue to be substituted. This has caused more delay in PDs moving forward.
- The 45 day rule to use the LC will force employers and Lawyers to work quickly on the application. Lawyers are known to be slow in filing process so they will need to change.
Lets hope USCIS, DOL and DOS make further changes in their regulations and the process is better suited to reduce the pain for applicants. FBI Name checks, long wait times in various steps etc are also worth reforming. On various occasions IV has drawn USCIS attention to various items in the greencard process that need reform. IV will continue to raise all such issues that hurt our members with media, USCIS and lawmakers.

I dont think companies are really geared to file for 140 within 45 days of labor approval...
The condition is not for "to file 140 within 45 days of labor approval"
But it is for the company to substitute the LC for some other employee.
There is no time limit set to file I-140 for the employee for whom the LC was issued.
AILA opposes this 45 days condition on the premise that they can not find and recruit a person to apply LC substitution within 45 days.
Anyway it is good to see majority of the "LC-jumpers" will be stopped.

Thank you. I am trying to find out if people have got denials in spite of going through the NOID process.
Received one today.
Weirdest thing:
Person's 140 was revoked by employer;
person received notice of intent to deny. NOID clearly stated that 140 was revoked by employer then quoted ac21 law and said beneficiary may be eligible and to give job offer letter.
person responded with letter from new ac21 employer with perfectly matching job duties/descriptions.
uscis sent denial. Denial only stated that 140 was revoked and 140 immigrant petition is needed to get greencard.
Don't know if this is a new procedure that they are following the main law where a valied 140 is needed the whole time.

This response should help us to focus on what to ask for in FOIA/efforts through senators. It is a pointer that we won't get the required info unless we clearly specify what we want.

If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. There is not much we can do. From Greg's yesterday's latest response that there were very few which were returned/rejected on July 2nd itself and this thread proves that we are not alone ...there are so many and status is unknown. Matthew Oh is also suggesting that it will be receipted. I think we are all safe and with time we will get receipt. Nobody...none of the attorney's are suggesting refiling. Now the thought that whether my packet was properly filed or not? I think that will always be there in the back of one's mind but if the attorney has done his/her job correctly I think we should not worry. Its not rocket science and documents required for filing are well known...so I would discount this risk. It appears we are all safe because as we all know that no rejection notices have been generated, packets if returned should have come back by now as per Greg....All in all it all points towards our packets being on hold there at respective centers....but as you rightly pointed out..towards the last week of July keep calling centers to know..but even before that keep eye on check clearing as that by far is the best and earliest clue that all is well with the case.

Its all about Money in US and its lobbying power, hence it is not going to help in anyway for us.
