    From the Perm Data there are aprox 21k perm Eb3 labor from 2005 to 2007.
    2007 : 13K
    2006 : 8k
    2005 : 300.

    So the rest 7K are BEC labor.

    In any system if you club large group of applicants based on a dichotomy, and say you will get lesser share than the rest, isn't that how you describe preferential treatment ? Is there any other way to describe the current country-quota system?

    Continuing on your example. Let me give another example of why this quota system is ridiculuous. Let's consider a Srilankan Tamil and an Indian Tamil. What would be so different between the two, in terms of social contribution to the US, that the 'diversity' rule makes an actual difference? Again what is the great benefit achieved by making it easier for one group to get a GC over the other? You can even think of other examples too.

    I dont' want to start off a culture war here by making controversial statements, but try to understand the core of what I'm trying to say. That is, there is no perceivable difference between you and I, at least in terms of employability, that this diversity concept can make a meaningful benefit out of.

    In fact it probably makes much more economical sense to have quotas based on the subject's political or scientific inclination rather than national origin! In today's connected world, nationality has no meaning.

    I would say it is a matter of pure judgement. It helps to stay neutral and make your best bet. For example, if you found a great job and the employer is willing to sponsor your H1B - why not go for it? H1B will be safe(r) anyday - it gives you and opportunity to plan for the unexpected. However, it would be imprudent to ignore a great opportunity by sticking to H1b. So, the thing is - don't lean on either side, just do the best that keeps you happy and safe.

    One question though - If I apply for EAD & AP - do I have to keep renewing it inspite of using my H1b status? That would be a great loss money, right?

    I am on H1B and plan to have my own company as a trader to trade stocks.
    I will be the owner and wish to draw profits, may not have employee in my company for now(please advice, if i need to)
    I need inputs to know what type of company should that be (LLC, S Corporation.. e.t.c.)?
    Is it advisable to have a GC holder/citizen as partner?
    What form of income should i withdraw(salary/profits/dividends/Interest..) How is the income considered when i file my taxes?
    I am not aware of anyone who can sponsor my H1 as a trader atleast for now, if i get the right opportunity, i am open for that

    1. If you want to trade stocks only, with your own capital ,then set up a LLC or C corp. If you trade other people�s capital then maybe become a RIA.
    2. If you form a llc you become a employee of your own company (say managing director, CIO etc) and sponsor your own H1.
    3. You can have a fixed salary and a draw, which is what a typical trader gets. Draw is a percentage of the profits you generate by trading.
    4. You don�t need a gc/Citizen as a partner.
    5. The company/fund makes money by trading securities and the earnings are retained by the company, you draw salary and bonus.
    6. You file taxes as a regular employee would.
    7. You might be able to get H1 from a day trading firm, a day trading firm is not a market maker. They trade company capital and typically you have to post some risk capital based on which they will provide you leverage and provide you with equipment etc. You don�t get a salary, just a draw.

    But let me ask you something; I am not aware of your expertise in the markets so forgive me if I sound patronizing.
    1. Do you have a seven figure capital pool? You will need at least 1MM if you want to make a living trading.
    2. Are you aware of the equipment and ECN and direct access software needed assuming you are technical trader.
    3. Do you have a prime broker who is going to provide you leverage and settlement? If you have not decided consider Interactive Brokers.
    4. What kind of risk management software will you be using?

    If you are in the NY/Nj area I suggest try day trading at a firm posting risk capital (typically 10K) then decide if you want to do this full time. It will also help sharpen your skills. If you want I can recommend a few. They will not sponsor H1 though, you will have to have some consultant do that for you.

    I agree with PlainSpeak, it is better to get it evaluated. Also, sorry i did not read your earlier post cleary. Both my friends did a MBA and not a MCA. I know of a collegaue who is in the process of applying under EB2 and she has 3 year MCA degree in addition to her 3 year Bachelors.

    EB3 I is going to have a long wait. I had applied for Canadian green card and had received it. At present i have EAD and AP. Is it worthwhile to go into consular processing and work in canada or apply for a blue card or think about Australia. If this sounds okay how should i proceed.

    gctest is a perfect jackass, think he is also a complete fraud.

    If you look at his posts, initially he said despite holding a doctorate and being around since 1996, he is EB2. So far so good.

    Then he says his dependents got approved on his EB2, while his case is rotting (????:D)

    The story changes dramatically after you point out if he is the real cream of the crop, he should have been easily qualified for EB1.
    The latest, breaking news is that he's from a top-notch research univ and has approved 140 in EB1 but still he's gonna fight for what's fair and against what's unfair (:D:D:D:D:D)

    Everything is made up, because the story changes all the time, when you attack him. I think the truth of the matter is he's EB2 and he's lying about EB1.

    His case never ever qualified for EB1 (publishing some academic trash doesn't qualify you for anything, see my earlier post on this thread regarding this), so he's completely sore and has lost his mind.

    Q.1) I understand you can't file 485 for your spouse if PD is not current but does the PD need to be current to add your spouse as a dependent on your 485 application w/o filing 485 for her?

    Q.2) Q.1 raises Q.2. When the dates are no more current, is adding your spouse as a dependent on your 485 safe enuf for her to be considered for filing 485 and getting GC when the dates will be current in future.

    Earlier In this thread- page # 3, I had setup a 485 kunwaras mailing list. I spoke to 3 different attorneys including murthy's and came to this conclusion- hope this removes lot of redundant questions.
    First of all, I work for LitIGATION technology company so please - don't doubt any accuracies - All our clients are top attorneys and I have used all my resources and this is the most creative idea i came-up with

    How to delay 485 approvals - - - -
    Wait for 15th July- If PD is current in August - don't apply in July , if not, go for last week of July
    Since there are ton of cases, one will not get FP in traditional 30 day but they will get it around 60-90 days (assumption based on ,immigration and immigrationvoice forums and comparing influx with 1999-2000 dates becoming current situation. Yes, i have taken into assumtion that there were 195K h1's that time )
    Ok so it's september already and you got your FP! But you want to have a total period of 1 year without losing your pd or your file in queue.
    If dates are current in August then rescheduling september FP will go to December/November at the best!
    Then you complete the fp process and the average time is 8 months - considering the flood of applications and dates will definately hit retrogressing in Nov-dec, They will assign cut-off dates. lets assume they go back to where the dates were in May/June 07 , then ,you will need to see where you are in the queue. There are some creative ways of generating an RFE (without getting 485 rehected due to initial evidence)- but it's not recommended ;-).
