I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..
What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card. How do i know? .. I went through it...waiting for GC for the past 4 years.
I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.
After you apply for AP its only 1 year H1 increments.
What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.
We had a small revolt (peaceful way) and its successful. We dont want to stop there.
LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING
I hope you guys are with me..looking for your comments
I am wondering about the same question. Recently, I read about the portability rules and they are so unspecific that I am not sure I want to take advantage of them. Not even Mr. Shusterman could give an assertive answer in his Q&A session (http://immigration.about.com/library/weekly/aa012902b.htm). He said you should not renounce your job two days after the 180 have passed, but when is the right time? I am getting more and more confused and depressed about this whole situation and about finding the right moment to decide whether I still want this.

I think this is great idea EB3_NEPA. We need to work on this!!! A good interim solution. That way we can actually show the contribution that we can make to the society as a family. Does anyone have an idea where we can start?
How about sending letters to our representatives and then contacting the media on the plight of our spouses rather than on us!!! May be the human rights folks can help us on this.
can the H4 not apply for a new H1B? Is H4 barred from applying for H1B? If not, I don't see where the prob lies. plus how will this solve the retrogression issue?

Thank you for posting this action item on other websites
Pappu,
Great job. Can you please make the below item, with better words an action item and have it on the top. I know you have hardwired it, but we want more attention to this. This is same like writing to all those folks who want to hear from us. I have voted in 10-15 questions.
All,
Please do this, register yourself, and search for "immigration". You will see 10-15 questions. Please vote for them. Please pass on the message to your friends. Obama wants to hear from us..
http://change.gov/page/content/openf...17_private_url
Its better not to create the same question again. Please do. This is our chance.. Let us be heard.

For PMP I think, you need to take some courses, I had taken some courses at Berkeley Online on project management, these courses count towards PMP.
They also have in class courses, if you are interested.
Better to do something than nothing.

Hope it helps,

I am not sure if that is going to be an advantage since my PD was not current in JUNE
For all practical purposes, the date on which it was recieved is your RD=> Receipt Date. The postmark date has no relevance except for records unless USCIS explicitly states so ( which it did once in 2001 http://www.uscis.gov/propub/ProPubVAP.jsp?dockey=89a5f3cee754ad0499e55e731191f 360).
485 filings are strictly Receipt date. I am still searching for the uscis link and will post one as soon as I find one.

Yes, that is right, I said “plight of EB2-India”.
I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.
For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!
most ridiculous argument and surprising because it is coming from a Phd. Surely, you must have defended your doctoral thesis, or did'nt you have one ? :p
The people who go for Phds should know that they are sacrificing short-term future cash flows in exchange for a far superior long-term cash flows. The others "EB3" go for a more milder but increasing series of future cash flows.
To each his own!!! But when people say that "my career is over because my gc is delayed" UNDERSTAND that they are venting their frustration. It does not mean that their career is really over.
And, like you, they will also work here as long as they like it and if not, go back...

I like the idea of an annual $100 fee to join.. that way all members have contributed.
Secondly, i think while a forum method is good, the Administrators should stop posting vitriolic messages ( For Ex: " I cannot believe people are not donating" / " you should be ashamed.." and such).. This creates a very childish image for this organization.
If there are 25k members and your funding drive is for $30k, why don't you accept $5 and $10 donations?.. Why only $100 or above?.. With 25k members, if we start a drive to donate $1 / member and only 1 in 10 respond, you will reach your funding goal.
My thoughts..

This is an excellent idea. For those who have already registered on change.gov know how effectively the president-elect is using this website. I get regular updates on whats happening with their healthcare initiative and they also regularly ask for people's opinion on different issues.
Alterego: Great point-to-point elaboration. Folks remember to add up your own story based on these points and I think we can expect some positive results.
We need to increase the intensity of this campaign.

if you all use little more IQ, you will realize that only with donation/money you will make a difference.
We all are here to make someone rich(employers, local businesses). So if you can make polititians rich, they will do something for you!
So stop calling... start donating to IV...
Let me know if my thought is wrong!
Money is important and has its place in the process. Grass roots effort is also important. What would you tell if some one asks which eye is more important to you? left or right? If this Q was a stretch, ignore it. I just used it to tell that $$ and grass roots efforts are important
Money does not get every thing done. Corp America is doing everything they can to get H1B numbers increased. Do you think they are being stingy with the money they need to spend? They have stronger opposing grass roots groups like Numbers USA, FAIR etc. Our issue is a lot less volatile compared to the H1B increase issue. How ever our issue is unknown to many lawmakers until recently. I am positive that some members came to know about the bills when we called them or have been approached by our state chapters.

Is it correct to say only nebraska Service center is issuing the rfe because they are pre adjudicating while Texas service center is not issuing rfe because they are not pre adjudicating 485. A vast majority of people getting rfe on 485 (95% or more) are from nebraska Service center.

check the latest release on July 17.pdf. I am not sure how many applications are rejected on july 2nd ...If one did not recieve rejected package it means, they are going to honor the application as long as initial evidence is right.

USCIS Announces Revised Processing Procedures for Adjustment of Status Applications (41KB PDF)
July 17, 2007 - U.S. Citizenship and Immigration Services (USCIS) announced that, beginning immediately, it will accept employment-based applications to adjust status (Form I-485) filed by aliens whose priority dates are current under the July Visa Bulletin, No. 107. USCIS will accept applications filed not later than August 17, 2007.
I agree with you. USCIS withdrew VB#108 (revised Visa bulletin which came out on July,2nd).So, They should accept our applications, if they were properly filed but the update didnt clearly mention that they accept applications which were filed in the first week of July. So, there is still some ambiguity exists.

Folks - another update on my case.
As i had been following up my case with the help from my Senator's office, they requested USCIS to give a written decision on my MTR.
Here is the written decision that USCIS gave
"On March 27, 2009, you filed a motion to reopen. You indicated the use of the applicant's ability to "port" under section 106(c) of the American Competitiveness in the 21st Century Act (AC21). The requirements were met and the motion to reopen was approved.
CONCLUSION: It is concluded that the grounds stated for denial have been overcome.
ORDER: It is ordered that the motion to reopen be approved. The Form I-485 is "pre-adjudicated" awaiting visa availability."
I hope this encourages people to go ahead with AC21

Hi All,
All this memo states is that USCIS will not automatically expedite the FBI name check simply because a writ of mandamus is filed. This memo signaled a national shift in the way USCIS responds to these types of lawsuits.
The U.S. Attorney's Office will now fight the writ of mandamus lawsuit by filing Motions to Dismiss and Motions for Summary Judgment. While this obviously lengthens the time it takes for a case to proceed, it is still very possible to win and force the government to adjudicate the application.
Hope this clears up any confusion,
Justin Fok
