Labor substitution may be legal but it is unethical. When everything depends on when you join the queue, how can one cut the line?
Whereas EB3 to EB2 porting is both legal and ethical. When you have a EB3 applicant that is waiting in line for 8 years, he/she had already gathered that much experience based on his long wait. Also, if you look at EB2, it is one of the highly abused category. The EB3 applicant who started in 2001 has joined the line half a decade before the one with 2006 Eb2 PD. One can't really accuse him/her for cutting the line just like one can about substitutes! If the EB3 porting case deserves merit, then I strongly support it!
My intention is not to to start a fight. But we need to see the true picture. Without acknowledging the problem how can we fix it?
Bottom line, GC abuses need to stop and we should fight for it as much as we fight for our rights to get GC!

You still have Eb3 to eb2 conversions, labor subs etc. So 1 lakh 485 including dependents is good for 2004 and 2005. With per country quota of 3800 + row scraps I still think a person with PD 2006 Eb2 will wait a decade to get his green card or end up at Silicon valley of India, Bangalore.

IV members, we need your stories. We are going to make an all out effort to pass this on to senators/media folks to realize the urgency of the situation.
Who's story do we need?
Your story about how you are affected by retrogression/back log etc. It could be as simple as 'I have a BS in Mathematics and am stuck in back log for 2 years and cannot fulfil my dreams professionally' to 'I have a PhD in Nuclear Science and US needs me coz there are only a handful of us!' Anything and everything works.
We have literally recieved stories of stay at home moms (because of H4 they cannot work) to folks who have been interviewed by MIT! The whole spectrum helps.....please please send us your stories...we need all the weapons when we go face the senators on behalf of IV
Why we need your stories?
Media folks
Sometimes we get approached by journalists who need a story the very next day. They are looking for specific subjects for the story though.
An example is say the Investors Business Daily (a financial daily). A reporter might come to us and ask us if we have anyone from the Finance sector who is suffering due to retrogression and is willing to speak up about it. They might also add that we need only Eb1/Eb2 category folks.
When this happens, we are in a mad scramble to find folks who fit this criteria so that we do not lose this chance.
Another example might be of a Medical Journal looking for doctors stuck due to retrogression.
We are constantly getting requests like this but cannot capitalize on it because we do not have enough stories already available to fit the criteria.
So please send in your stories. It need not be earth shattering at all (most of us are mere mortals). You never know when a reporter is specifically looking for a story similar to yours and you might just tilt the balance in favor of skilled immigrants.
We promise we will not reveal your story to media if you do not want to.
Though there is no harm to reveal one's name in media as can be evidenced by the folks featured in the Roll Call article, Philly Inquirer and News Observer.
At the same time we understand that you might have reasons to remain out of media and we will fully respect that.

For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.
When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'
Lately when we go to meet them, most of the staff have already visited our website multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.

this got to be the best practical solution I have seen on IV (with some modification?), approaching hillary clinton by explaining the situation is the best bet, its simple and involves an administrative fix but they anyway have to revisit the application during visa allocation,
what if a person's 485 is approved like 4 years back and he had some run-ins with law after that or something that might jeopardize his chances of 485 if it is evaluated at the time of visa allocation? this might be a 1 in 100 case but its a national security issue, solution can be as one of the members said pay an upfront fee for pre-evaluation and then when visa number is available they don't re-evaulate parts of application that don't change like birth certificate etc.,. and just look at w2s, paystubs, criminal records etc.,. in that case if it is just a pre-evaluation I am not sure how it would be of great help unless the package comes with EAD and AP,

Since you have not applied this time...you cant get in this years Quota..so get an job where you can get h1 sponsorship next year..So take off to india once your opt is over...get the employer to get you the h1b papers once approves and start to work next 08 Oct1...

Cost of attending the meetings with lawmakers and seeing every IVian, that attended the event during the last three days, working relentlessly for the entire immigrant community stuck in the huge greencard backlog : PRICELESS PRICELESS PRICELESS :)
I think, the event was a huge success and the outcome of the meetings were positive. I wish at least one representative from each state participated in the event. Some offices insisted that they talk to their constituents.

This is a big lie. EB3 went totally unavailable in July to September 2005. When eb3 went unavailable that means no country should have gone over their 7% limit. However, statistics show that certain countries did go over the 7% limit. This is where USCIS/department of state broke the law by giving visas to certain countries that they shouldn't have.

Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).
So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.
Would that suffice? Could the petition be denied?
I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.
The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.

I think this is the best idea that I have seen on the forum so far. Out of all of them so far....rallies, flowers, pizzas . Really speaking, if this action is indorsed by IV, this would be great. I think this is doable and does not require any change in existing rules about visas. I am all for it and many thanks for the suggestion.

I have a problem where my "Given Name" is entered as "<first name> <last name>" in my passport (India). The "Surname" is left blank. I have been in the US for 7 years now and it has never been a problem so far. I usually enter the "<last name>" in the last name column on all documents. I wonder if this will cause problems during the I485 name check stage. Any one here who can throw some light on this issue?

I had the same issue and I got it changed from Indian consulate NY. The whole process took around a week. You need to advertise in local newspapers which is not a big deal. Around Rs 200 in indian newpaper and $70 in US newspaper (Classified section).

hello guys, i just went through all the 6 pages but still am confused.
This is how my name appears on my passport:
First name- ______(blank!)
Last Name- Ravneet.
one every US document including SSN, License, Job, its listed as FNU Ravneet.
I am on F1 visa, working on my OPT. My student visa just expired but my OPT-EAD is valid till june09. I feel very embarassed when asked" how do u say ur first name", I need to have it changed, could somebody tell me step by step the process involved.
I can drive to NY consulate and have my passport changed, but then how to change every US document, I mean would a expired US visa be a issue? My EAD is valid and I am legally in status. Please guide!
It is clear that FNU stands for First Name Unknown. Question is why did you allow this to happen even in your first document. Perhaps for passport you didn't bother because it is blank, but letting FNU appear as your first name in a document does not make any sense. First thing should be to try for the passport office, and hope that they will correct it based on whatever your documentation (school certificate etc) can support. Perhaps it might be that what is shown as your last name, is in fact your first name, etc.

I can drive to NY consulate and have my passport changed, but then how to change every US document, I mean would a expired US visa be a issue? My EAD is valid and I am legally in status. Please guide!
It is clear that FNU stands for First Name Unknown. Question is why did you allow this to happen even in your first document. Perhaps for passport you didn't bother because it is blank, but letting FNU appear as your first name in a document does not make any sense. First thing should be to try for the passport office, and hope that they will correct it based on whatever your documentation (school certificate etc) can support. Perhaps it might be that what is shown as your last name, is in fact your first name, etc.

Single most important reason I have not bought a house yet is that I do not have a GC and thus can be kicked out anytime. Most of my savings have been invested in Real Estate in India not because I think investment there is more profitable but because I do not have confidence that I will get GC here for sure. All of my friends who own a house waited till they got GC and those who do not own one, are those waiting for GC. In short, more GCs to Desis generally would mean increased housing demand, at least that is what the initial look at numbers indicate. Thoughts?

good work Sherman_tribiani, i am watching this group of "highly skilled job stealer” for sometime. they merely talk and do nothing. most of them r scared to do anything. they r scared of u & me. they r not scared when they steal our jobs and we will scare the hell out these ba$tard$ to make them do in their pants before we kick them out. gheen told me about this group and he also said that not to waste my time on these job stealers as they r weak and incapable of doing anything, other than stealing our jobs and outsourcing.
