Hello guys,
Sorry for this non-immigration related post. We have this sudden, tragic situation that I wanted all of your advice on. Thank you for your time in reading this long post.
We had hired an Indian nanny in NJ who, we learnt after hiring her, is here on a tourist visa. We were paying her $350 per week cash, which is the standard rate around here for nannies (incl. citizens and people on GC). We had liked her when we met her in response to an ad on Sulekha, and we thought an Indian nanny would be good for our first child. She has been with us for about 3 months, and we were intermittently not getting a good feeling with her for some reason. We finally bought a small security camera and installed it yesterday. On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions. Needless to say, it has shocked, angered and extremely saddened us. I showed the video to a couple of friends and even they say it is unbearable to watch. This was just the first day of recording and it pains us tremendously to think what all may have happened previously.
She is of course not going to stay with the baby alone anymore, but I want to know what legal options I have to penalize her to the fullest extent, so that she does not do this to anybody else�s small babies. She it seems had come here last year and taken care of someone else�s baby in Hoboken, and I can imagine that their baby also went through this. (This woman and her husband are a ~ 35 year old couple, who have a multiple entry ten year tourist visa; both come here for 6 months every year and work odd jobs like this. They apparently got a (unsponsored) tourist visa after showing a lot of landed property in India).
I specifically want to know if I will have potential problems if I go to law enforcement about this- regarding have employed her (both of us are on H1B visas). I know we have made mistakes and should have done better due diligence in this, and there cannot be any more punishment for us than seeing our 8 month old � who cannot tell us about it when we come home- being beaten on the tapes. We saw this yesterday and have not told her yet. We want to weigh all options before we proceed, but from today onwards one of us is home all the time till Friday. Any advice or opinion is sincerely appreciated. Thanks for reading this long post. And, to all who are thinking of nannies or have one, please learn from our mistakes and closely monitor your child�s safety every day.

Vldrao is not a god. His assumptions are based on the facts from USCIS data, Do you know that 22k visas were not issued. If yes,quote that. Nobody knows and all are playing guessing game. Leave him alone.

For me as one, I do NOT think 22K visas were used up in 21 calender days(ie approx 15 working days).

Well, one does not know the exact pre-adjudication policy at the service centers i.e do they re-open a pre-adjudicated file after a certain time period or something in the several database changes that prompts it.
One thing we need to remember and is certain is that, in the month of June and July 2nd of 2007, just before the fiasco thousands of GC's were issued (much much beyond the capacities of all I-485 service centers). This happened only because of pre-adjudication. I know several who had gotten RFE's in the year before and simply got their GC's quickly in June and July 2nd. (with EB3-I PD 03/04/05 as well !)

If you asked whether processing is based on RD or ND, they will defnitely tell it is RD. One need to ask, which of two dates will determine case processing status, if your stamped RD is 3 months earlier than the receive date you see online. Note that the site tells you to contact them if your "receipt notice date" is prior to the published date, and you are still waiting. What is "receipt notice date"?

there is such a huge backlog for Indians that even the news above won't help much... overflow from family category has slowed down and previous recaptured visas are over ..the news that CIR has been delayed could be good as there is higher chance that there maybe some sort of relief ..other than that the situation is HOPELESS !!!

What Details? I have mentioned in one of my posts here that my PERM has not yet been filed....No details regarding my green card processing.....Please read my posts to get more details on this.
Admin need to add three more options to 'Processing Stage' info in the header, 'Not Yet Filed', 'Not Interested in GC', and 'GC Received'. N/A should be removed, as there is always some Processing Stage.

Recently all of us in the IV community were thinking and worrying about what the future holds for skilled immigrants in this country. Day by day things are getting tougher! All of us in IV community (including the leadership) have different ideas about how to approach the problem. Under the IV leadership, we have a set of declared priorities and our lobbyists and community are working for those. Even when we work for those stated goals and priorities, we have to reevaluate what is feasible in the changing environment.
In this increased protectionist environment, Re-Capture, Country Cap Elimination and Immigrant Visa increase seems difficult if not impossible. So, I would like to propose a SMALL STEP, which would provide us HUGE BENEFITS and at the same time satisfy all stakeholders (including anti-immigrant community) as this is the least controversial method.
Some of us may say that this won�t work. Some of us support a big-bang theory. Some others argue for the already stated goals and priorities from the IV leadership team. I agree with all these groups of our brethren, but at the same time, I urge each and every member of our community to give a serious consideration of this proposal before shooting it down.
Please do not use this thread to point fingers at one another. Always remember, when you point fingers at someone, three of your fingers are pointing towards you and one stays neutral. Please try to avoid statements like the following in your reply to this post to encourage serious and productive discussion:
�Why didn�t you update your profile with all information?�
�What have you done so far for the community?�
�Did you participate in these so and so initiatives of IV?�
�You are a line cutter who used substitution�
Etc etc etc�the list goes on.
We have far more things that unite all of us than the few things that divide us. So, let us focus only those things that unite all of us. If we are united, we can easily solve all our differences. As AR Rahman said, always we have the option of choosing love over hate.
PROPOSAL
Our main concern with respect to GC journey is the UNCERTAINITY! I am sure all of us worried at least one time �What happens if my 485 gets denied after all these years of waiting?� Many of us here are expecting a GC wait time of 2-12 years. So, a denial at the end would be little bit disheartening.
The normal processing time of a 485 application ranges from 4 months to 12 months. For all the retrogressed countries, this would be 2-12 years. All of us, who are in the Adjustment of Status category, are legally allowed to stay and work here in the US. So, in no way we are additional burden to the country. So, all the shackles on the GC applicant and family during the years of retrogression period are not beneficial to anyone in this country and it is not protecting anyone�s job. These shackles just inflict pain to the GC applicant and family � that's all - nobody is benefitting from this!
So, if we can work to obtain Adjudication of all I-485s irrespective of whether the country is retrogressed or not � we have a solution. As per the INS rules, an immigrant VISA cannot be allocated outside the numerical limit. If the country is not under retrogression, the applicant will get his GC. If the applicant�s country is a retrogressed one, instead of obtaining the Green Card, I-485 processing-status could be changed to a new one such as �Adjudicated � Pending Visa Allocation� (meaning: Adjudication completed, Visa allocation pending). So, in essence, when the VISA numbers are available, then only the person will get Green Card. But at the same time, the applicant and family can feel the relief � No need to worry about RFE, NOID, MTR etc, because the 485 is already approved and it is in a Pending Visa Allocation status. So, in the case of all these retrogressed countries, the actual allocation of Green Card may take 2-12 years time depending on the availability. This option will go well with the protectionists.
If the status of the 485 application is �Adjudicated � Pending Visa Allocation� and the applicant�s country is a retrogressed one, S/he should be eligible to obtain 3, 4 or 5 year EADs with travel benefits associated. Also, the applicant should be able to take any job after 1 year of the status change date of the status �Adjudicated � Pending Visa Allocation�.
I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this won�t change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market.
Whom should we approach to get this done?
Ans: Hillary � Yes Hillary Clinton. She is the number 1 friend of people from China and India, who is in the current administration. Her department is also in charge of the 140K Visa numbers, Travel related visas etc. If we can get support from Compete America, prominent members of Indian and Chinese communities in US, Ambassadors of China and India to US and approach Hillary, we will be successful. Hillary may be very much pleased to start an initiative to achieve this, as she has a chance to influence 700K+ Indians and Chinese immigrants in US, in a very positive way. At the same time, politically this won�t create much problem � Status quo will remain the same � even after such an administrative fix. There is no net addition of immigrants to this country.
With Hillary�s support, if we approach Janet Napolitano, we may have a solution.

So, once we obtain this admin fix (first step), then we will work to obtain the Allocation of GC issue for all those folks who are waiting to get the GC allocated.

We understand your frustration, but we would need some more info from you. Could you please look at the first post in this thread and send us your info.
We already have about 30 stories sent to us and the truth is we are in much better shape now when we go to meet senators. We can actually point out examples and not speak in general terms which makes them sit up and listen.

I will pe posting a sanitized version of the stories as and when I find time (no personal information will be revealed and I will take utmost care to ensure that the story cannot be traced back to any individual)

Personally, though I had an inkling, I had no idea the situation for even brilliant individuals was so shockingly bad. As a core member of IV if I feel this way, I am sure that the lawmakers have absolutely no idea about how highly qualified yet unfairly treated all of us are.
We at IV have achieved quite a lot of success at DC by meeting many many senators and now atleast they are aware that highly-skilled immigrants are facing issues. Most also know about some org called Immigration Voice which has been making quite some noise since the last couple of months.
We are pretty confident that when our stories passed on to Senators it will definitely benefit us and convey the stark reality. Maybe a jolt like this is what is needed to get them out of stupor
Lets work together to make sure that our sufferings end.

I agree with you totally on this chanduv23.
Doing things legal ways is just fine in most cases. But there are some times when you need to decide and treat people in a humane way.
A saying goes. "Headache pains are known to only those who have it and suffer." Somebody was arguing that scientifically delivery is just a natural phenomenon. But the pains and trauma can only be felt by a woman who delivers and there are circumstances when you are forced to be in shackes during delivery.
Hope this sensitive thread does not divide the IV community.

I have been on IV and actively participated in a lot of campaigns and events and interacted with a lot of people from different walks of life, different nationalities, different situations etc ... WHat I have noticed is, everyone has their own opinion and stay entitled to their opinion. Everyone wants to be judgemental through their opinion.
Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.
Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....
If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"

I have been living in US for close to 10 years now and though I am proud of fellow Indian community and their achievements, I have also noticed how the community is divided and oponionated. Forming so many sub groups, promoting caste feelings, fighting each other, trying to piut down other fellow community members, lack of unity and what not ....
If everyone in this world want to be considerate and help - then there will certainly be a day when we can see a world without poverty, wars and all the issues we are having today.
Doing things legal ways is just fine in most cases. But there are some times when you need to decide and treat people in a humane way.
A saying goes. "Headache pains are known to only those who have it and suffer." Somebody was arguing that scientifically delivery is just a natural phenomenon. But the pains and trauma can only be felt by a woman who delivers and there are circumstances when you are forced to be in shackes during delivery.

Very well said. I have been on IV and actively participated in a lot of campaigns and events and interacted with a lot of people from different walks of life, different nationalities, different situations etc ... WHat I have noticed is, everyone has their own opinion and stay entitled to their opinion. Everyone wants to be judgemental through their opinion.
Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.
Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....
If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"
Hate no one for what they are or how they are. Try to see if you can help. Just help.
