Not sure about you, but a lot of the people enrolled into the doctorate program in the 2001-2004 time-frame out of necessity. They could not find a job after their masters and decided to go for the quals as a fallback. If you did actual research, you should have enough publications and acclaimed research to get you into EB1. If not, well then there's no need to cry in self pity here because you are getting exactly what you deserve.
If you read (and understand ofcourse), my gripe is not about my lack of ability or desire to file as an EB1, what i was pointing to was the general ridiculous notions being spread that
a) oh all EB2 India applicants are so "lucky" to have filed it in 2006 and getting approval now, so soon
b) EB3 India has been treated "unfairly" by USCIS
c) All of us "deserve" GC asap regardless of the numerical limitations on EB categories, oh this evil system.
Obsessive compulsive LUD checkers calling USCIS at the drop of a hat are a big part of the problem. If people could understand this simple fact that every minute that an IO spends telling some idiot if his name check is cleared or not could have been well spent in approving a GC for someone else. Every frivolous service request hurts the legitimate ones.
These forums were started with the best of intentions at heart and they do have useful information BUT now almost everyday, it is the same old story.....same question, same answer (ofcourse followed by the standard ..i am not a lawyer or go hire a lawyer and topped with oh, i contributed xx dollars to the "cause")

whats up with USCIS issing RFE's and stuff for people with PD's so far away..Iam not sure what the RFE is but it makes me wonder what USCIS is doing with files with a PD of 04 that too eb3..:rolleyes:

Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
however after coming here , Paid for my own ticket and landed here on start of january 2011.
Confirmed my arrival to the employer too. Since my leaving the home country there has not been any mail correspondence from the employer , though i have been writing many. Talked to him over the phone and he said he wasn't responsible for my arrival as he doesn't have any project for me. Waited to get another job as a H1B TXFR but stuck with trnsfrs issues due to non availablity of paystubs from him.
I never reported to work as he said dont come to office, dont have any paystubs, but have all my H1B papers , I97 and Employment offer from that consultant. I have decided to leave back to my home country but not before reporting this blood sucker to DOL.
I need to clarify a few things before i nail these blood suckers
1. How long before i board my flight back home , should i send the documents to DOL
2. I have the originals of H1B filing and LCA and I94, are they rquired in originals
or copy to send to DOL
3. What other documents should i send alongwith
4. Do you think my case will get weaker if iam not here ? As i am flying back to my home country.
5. I dont want these suckers to go scott free, so how to build my case here , can i ask the DOL to recover my wages for 4 months i wasnt getting paid.
I do not care if i get any wages or not from them , but i really wanna see the locks on the gates of this company. They shouldn't take H1B and its applicant for scapegoats.

I had called the congressman from my district (Peter Visclosky) along with the other representatives on the list a few weeks ago. His office had taken my name and address at that time. Today I was surprised to see a letter in mail regarding that conversation and his intention to support the immigration bills in house. For those comparing IV with free web-based services like Google/Yahoo/Hotmail/others.... you probably don't grasp the idea behind IV, and this is precisely one of the reasons why a membership-based organization is desirable... :
- IV is no gmail or hotmail
- We don't get advertising revenue,
- Nor have we gone IPO like Google/Microsoft/Yahoo (neither can we... :)
- Nor are we funded by wealthy VCs
- Nor is this a "business model"
- and Nor do Google/Microsoft/Yahoo care about your immigration woes... .
Bottomline - we're not a business, we're a non-profit organization - that needs funds for operations and lobbying efforts. There are normal operational needs that are taken care of by membership dues in most organizations. There are special one-time needs that are taken care of by funding drives.
So let's rise up above this madness...

But that would happen only if i visited the site very often. I would have missed it if i am not a regular visitor to the site.

It all might be nothing if you think everything is correct: meaning there is no fraud on your application and your employer is not blacklisted.
Please consult a lawyer raher than worry yourself crazy to find out more.

I checked with both pediatrician and Civil surgeon and they both are of the opinion that TST test would not impact a nursing mom.
My attorney told me that my wife needs to get back before her scheduled trip. This would incur huge costs plus it would be difficult to get the seat arrangements. ( We have a twins and we have seats with bassinets for the infants). My father is also travelling with her.
Is it possible to ask 1 month extension for RFE based on the difficulties. I'm EB3 IND PD 2003 and I dont think our I-485 is waiting for adjudication any time soon.
I've scheduled an infopass appointment tomorrow. What are the chances of getting an extension when I present my case to IO?
I'm worried and it makes us very anxious.

1) did you talk to your lawyer?
2) if # 1 is ruled out or of no use, I would personally draft a letter showing that she is travellling right now and with kids and it would be extremely difficult to get her TB test done as you cant get it done by that RFE due date. add some more stuff telling your situation as to why she cant come right away due to the stuff you mentioned (kids/babies ). IAm sure you WILL get it exteneded.
