We do see such threads on the forum occasionally where the employee is being cheated/asked to sign a contract/is not being paid on bench/employer is threatening etc etc... There are several instances where members have posted negative comments about consulting companies and how employees are unhappy working for them.
Is this really true?
I want to understand the reasons why people are not filing lawsuits against such companies yet? Why are we not reporting them to DOL and USCIS? Especially after filing I485 and expiry of 6 months, people are in a better position to file lawsuits against such employers.
IV can help only if people are willing to be helped and ready to take action.

if he is a typical consulting guy with less than 50 emps, he won't do it, because such employers almost always make "adjustments" that puts them in extremely weak spot during such law suits. here are some examples:
- a guy was laid off, his new employer sent him on a project even before filing for his H1 transfer
-many consulting companies do not pay salary while the guy is on "bench"
- they many times knowingly/unknowingly commit tax/accounting fraud or regulatory mistakes that can cause serius consequences
- a friend of mine was interrviewed by a client and when the result was positive, his new would be employer called him at a McDonalds and asked him to sign the contract right there (within 30 minute of meeting), and my friend did. Now most people won't see anything wrong in here. but a lawyer told me that my friend was not given enough time to read/understand a legal document and to talk to a lawyer ideally enough time is about 2 weeks. How many small consulting companies give 2 weeks when the interview at client is clear?
In your case, the end client is not your employer's client. Ask him to show the contract between him and the end client.
bottom line of the story is: there are many defenses that one can play and win the case and/or even put the employer in trouble. That's why most small employers don't do much beyond sending a lawyer's notice (just to scare you enough to write down a check). A real nasty guy can even go one step further and file a law suit only to withdraw it later if you decide to fiight it.

I filed 485 in Sep 2003.
First Finger Print is done in Aug 2004.
Second Finger Print is done in April 2007.
Took Infopass on Sep 11th 2007 and I was told by Officer that everything looks good but still pending and asked me to check after 2 months.

Members are always been targeted for contributions for lobbyists, free lunch etc. and yet nothing concrete have been acheived by IV. I have never seen this website(immigrationportal) ask members for a single dollar yet have been just as helpful or even more helpful than IV and also this website is flame free you can express your self without fear. I am with the same employer who sponsored GC. Until GC was approved I was with H1B visa. Is it neccessary for me to file I-9 after GC?

The only difference between the historic data (1930/1960/1990) and 2008 is that, we are in globalized economy now. The crash you are seeing now is much much different than what anybody has seen before.
Crude prices are crashing because the demand growth projections Goldman sachs had was based on availability of which is not the case now. So, demand for crude is lower and hence oil prices are crashing. Look at GM and ford. They are going down too, because auto sales are doomed for next 2 years.
The problem why Gold will go up is multifold.
China, OPEC countries have huge dollar reserves and hence would like to diversify their dollars. The run up in Gold is just because China and few Oil exporting countries were buying Gold. Gold still has more room to rise. I am talking about physical gold and not the paper gold (GLD ticker symbol).
United States has to print dollars to meet the present crisis. At the same time, it has support those currency papers with Gold. Without Gold backing, dollar value will be crushed.
I am goldsmith and i do know the history of Gold going back to decades. I also read several books to top it all.
See the value of Gold after making inflation adjustments. Don't just look at the per ounce value in dollar terms.
Unless you look at money supply (m3), you will not be able to get a grip on Gold value.
Google on term 'brenton woods' and do some reading.
The only way Gold can be crushed is if
a) United States sells all its Gold holdings.
b) If some gold miner miraculously says that they found a mine with billions of ounces of gold and which can profitably extracted.
There is one theory floating around. United States may sell some of its gold reserves to make up for $700 Billions. However, there are buyers out there who would love to take that Gold. China's biggest headache right now is, what to do with their Dollars.
United States long term bonds are going to yield nothing and will be worthless.

The new generation thought stock market is for educated people where you understand the company principles/profits/analysis etc... But it is turning out more like GAMBLING.

I am from Bangalore. Most of the major cosmopolitan cities prices will remain stable(10-15% changes) . If you are looking at long term investment, go ahead and buy LAND.
After 5-10 years, you can sell and use it for your kid's education or you can construct
rental houses.
Make sure the LAND documents are correct and there is proper security for it.

- When a new employee arrives his/her knowledge of immigration matters is quite less and doesn't intend to take risks of going against the employers wishes. This is being exploited by many employers by way of threatening to cancel H1, intimidating that they will have to return back, instilling fear in all ways and means in the employees about the negative aspects. This leads the employee to think and step back in going against the employer.
Soln : Better educate the new employee about his rights as soon as he arrives. This could be either through forums, websites or even an official supplement from USCIS which should be handed over to the employee when his H1 is approved. ( It could mention and clear all myths officially by USCIS). This instills courage in the employee to question the employer if not go ahead with law suits. Also, this even may reduce threatening by the employer.
- Further most of the employees want their career slate to be clean without any law suit, dots, etc until their life is secured by way of GC approvals or some form of assurance from the Govt. This makes them step back on taking action against the employer.
Soln: Well if there could be a system where anonymous complaints/whistle blowers are allowed, they probably may come out. However, rarely employee wants to reveal his identity though he suffers.
- The immigration matters are so complicated with so many RFE's people are scared to add another their event to their history. Any transaction with USCIS is kind of a risky feel for the employee.
Soln: This feeling should be removed.
- immigration decisions are uncertain so people want to be cautious in taking bold steps.
Soln : There should be assurance from USCIS that provided everything on the candidates side is good that his GC will be approved. If an employee believes that based on his/her good credentials in all respects they should assured be of a GC, they may come forward to fight against the erring employers

So far from the poll results I see that most of us are here by choice ( though we are put thru GC waits). no matter what we will try to stay here until we reach our personal breaking point which would tigger us to look at alternatives.
Someone here asked what independence and freedom has to do with the Quit America thing. Most of the immigrant community feels that they are not given access to lot of things due to restrictions in their visas and unpredictable GC process. And the inconvenience and trouble their familes go through. With that in prespective I am thinking that we have lost atleast some of our freedom and independence.
This reason for this poll is to also make people think .

True, but you are forgetting the basic definition of demand. Demand is willingness to buy supported by ability to buy. If you are from any metros in India, think how many of your Non-IT, mainstream friends draw more than Rs. 50,000 per month? How can someone making even Rs. 50,000 a month afford 50 Lakh flat?
If there are 10 people drooling out side Ferrari showroom that does not mean there is demand for 10 Ferrari :)

This estimation ignores other NRIs in other country. Apart from this there are many resident IT folks makes 6 digit salary plays the role. If most of them tries to buy, we need to find another India. Indian real estates become a NRI colony,

What is a H-1B blackout?
Sorry by "blackout" I meant how H1B visas were used up in the first day this year causing hysteria and utter confusion in the community, leading to a lotter system in the end and 2/3 of applicants without the covetted visa.

Sorry by "blackout" I meant how H1B visas were used up in the first day this year causing hysteria and utter confusion in the community, leading to a lotter system in the end and 2/3 of applicants without the covetted visa.
