It is absurd. You need people, so accept labor application and approve it. Then you authenticate the individual by approving I140. Then because this 'number' not being available you let the individual and his/her family in limbo state for 5-6 years.
The mistake is not on their part; it is on our part. We are so desperate for the GC.
I would blame all the dirty politicians back home who have not let the country flourish and thus forcing the so called 'smart' people to seek residence else where on earth.
It is too much for a social animal to go through in 'its' life cycle.

And that's never gonna happen. All Green Card seekers have stopped filing in EB-3, they are somehow managing to file in EB-2 by hook or by crook. So until congress changes any Law, every single spill over visa will be consumed by EB-2s and EB-3 India is not going to get a single spill over Visa...

2. There are only 3000 visas available for EB3-I in any given year (7% of EB3 quota). EB3-I will get few more if and when EB3-ROW gets current.

I know there was a long discussion about this a while ago. My PD is in 2005 in EB2 category.
Any guesses as to how long it will take without any reform? Is there a good guess on the total number of pending LCs in the queue? I would like to take that number and divide by 1400 (2800 for EB2/2).
My guess is that with curret rate it will take anywhere from 10-15 years for EB2 to reach 2005.

You are hitting the right buttons here! You can say it is either laziness or fright/jitters or the comfort of current H1B approval/stamp that is making the large populace to sit tight.
Guess what, once some of the battles are won (we can never win all - they will always be ongoing), we should either knight pappu or induct him to "IV Hall of Fame".

I just want IV to be remembered for getting rid of retrogression and solving the GC problems that plague hundreds of thousands of high skilled immigrants. each and every member of IV is important in order to achive this. one member or even the entire core cannot do it alone if there is no support and efforts from IV members. For those who care to read...the fact that I am suggesting that people should port their priority dates before that door closes shows that I believe that people who have played by the rules (ie actually put in the 5 yrs experience or find a job with EB2 requirements) should get preference !!
I call this the plight of EB2 india because as the rules are set up, in theory, if majority of EB3 ported priority dates, then yes, EB2 with later dates would truly get the short end of the stick.
Having said that, the backlash against people like SunnySurya is unfair. From his perspective, he is right and the law grants him the right to sue if he feels so.
THe problem in these forums is that any mature discussion is not possible because any dissenting voice is soon suppressed with ad hominem attacks such as the gentlemen who wanted to buy me tickets to india.
Seriously, how much more immature can we get?
Even reading this discussion, NOT ONE PERSON has attacked the argument on a legal basis. INsults are aplenty though.
Legal arguments were already dealt with in the other thread, there is no basis to sue, as the porting is well established law. So is the requirements for EB2.
Regarding the EB3 to EB2 shafting EB2, well, you already know that most people will not be able to port because they are not willing to change jobs, or that the company is bit too strict about playing with immigration laws.
Also, a point to be noted when you say EB3 has had the opportunity -- you too had similar opportunities. You too could have been EB3, gained experience and converted to EB2. Instead you decided that it was in your best interests to follow your dream of getting a PHD -- a choice, I dont think you are be ruing, but for the fact that you find yourself placed behind all the guys who did not do PHD.
Plight of EB2? I think not. Even with EB3-to-EB2 porting, priority dates are well ahead of EB3 (even without the current jump, EB2 was around mid 2004), and now, I guess when it returns to normal, would be around 2005. So while not exactly current (like EB1, shouldn't they be "similarly entitled" to have a superior lead times), the wait times for EB2, compared to EB3 hardly justifies it to be called "plight".
But then again, to each his own. EB3ers other EB2ers waited almost 3 years for our LCs, people with 2006PDs did not even wait 6 months for it (both EB2 and EB3) -- and worse still are people stuck in BEC (who waited 4-6 years). And yet people in 2006 complain that they have "horrendous wait times".
EB3s saw tons of people getting through substitute labor, people who have no right to cut into the line ahead of us, significant portion of these cases (including EB2 substitution) are fraught with fraud, however the law was weak, and there was nothing that we could do to prevent such things. Lawsuits are useless for us to weed out such applicants, or even question their earlier PDs because they are protected by the then current laws.

you can add your spouses before an I-485 is approved. Once its approved, then you are in trouble. These dates are current only temporarily, and retrogression ("severe" as per the bulletin) is expected again soon. So go ahead and file your I-485 right now if your PD is 'late' (2006 or so) you will probably be on EAD/AP for a while.
if your PD is 2003/2004/2005, then as soon as 485 filing is done, start looking for your life partner :)

Now the question is what if (I know a big IF), but what if, I apply for my 485 (hoping that my 485 will be on EAD/AP for a long time) BUT my 485 gets approved rather quickly and I am not able to marry before that happens -- do I have *any* way to tackle that issue? Or would it then mean that my wife cannot come in US for n number of years after marriage?!

I agree.. you should be suing the other party in front of you for injuries since they were the ones who stopped and as the person said - offense is the best defense .
If I remember correctly the first car in front of you had already collided with the car number 2 and hence all the accidents. I don't know how they can put you at fault . So let the lawyers handle it and go all the way .

In accidents like this, most often the person who will be ticketed will be the one driving behind, the reason being that in the eyes of the law the person driving behind should maintain safe distance from the vehicle in front of him even accounting for the fact the guy at front might stop suddenly. This is a lesson for people tail-gaiting too close�.

I would think IT experience is the same anywhere so taking it to canada should be ok? If not there are plenty of other management jobs there. It might be a new start but in a one year timespan you will be well established.

As for masters, are you persuing MBA? How about PMP?
1. Apply for Canandian PR and then if you are lucky you may get a good job in Canada in IT or else you will end up working in Wal*Mart or some grocery store cursing why you came here. Canadian Companies wants Canadian experience. US experience is not enough! :(
2. Just enjoy without doing anything and hope that your GC would come before you die. :D
3. Do some Masters degree. I'm currently erolled in a masters program and would somehow try to finish it. It would keep me focussed and create positive energies in me. Otherwise due to utter frustration, I'm not able to concentrate and work. If you are wise enough you would understand that there is no place for you here in US and you would push off immediately. :)
