    HLG has confirmed that the CIS is not returning I-485 Applications back to those who filed I-485 during the first week of July. This is leading many to speculate that the CIS may reverse course and re-re-amend the July Visa Bulletin; whether the Visa Bulletin actually reopens remains to be seen. HLG normally refrains from commenting on rumors, but we have talked to several Washington insiders and believe that this is seriously being considered.

    They moved from 8/1/2002 to 9/22/2002.
    According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?
    Never mind the spillover, can ROW just get its normal quota at least?

    Yeah, exactly, that's what I don't get either. We know it's not a huge amount of cases they've got in that time frame, so what is the slowdown. This is maddening.

    PLEASE HIGHLIGHT RE-CAPTURE OF WASTED VISAS
    AND CHANGE IN THE LAW TO VISA ROLL-OVER IN FUTURE.

    I think asking for increase in visa numbers works against us, especially in this economy. They may not be interested in removing per country quota too.

    But, we have a genuine and strong case regarding re-capture of wasted visas. The root of this evil (retrogression) is due to wasted visas in last 5/6 years. Its quite simple math, US didn't stop/reduce H1 visas who get into the GC pipe, but reduced the number of people going out of pipe, hence the congestion.

    Please make sure u highlight this one. This should be top most priority all the time.

    I have been in the country Legally on a student visa and then on a work visa for 10 years. I have been in line and have applied for a greencard 6 years ago and my application has been shuttled through various departments and agencies in a 4 step procedure and now being stalled for want of a number (An immigrant number) for a highly skilled immigrant. There are an estimated 1/2 million legal law abiding, tax paying individuals in a similar situation who need your attention. All of them are in the country on a work visa and are in line to recieve an employment based green card.

    The Employment based green card system is completely broken due to excessive delays and backlogs in petitions of nearly half a million highly skilled workers who are certified by US Government to be doing a job that no US citizen is willing, qualified or able to do. The delays in obtaining a permanent residency are due to 2 reasons: Numerical caps on employment-based green cards and processing delays in adjudication of files. Today the system takes anywhere between 6-12 years to grant Green cards to some of the best and brightest of the world who have chosen America as their future home.

    These future Americans are facing huge quality of life issues and their employers are facing difficulty in attracting more of the best and brightest of the world due to the broken system. The system prevents these workers from accepting promotions and switching jobs for the time-period it takes to process their files. By stagnating career growth and suffocating the creativity of the most innovative and technical minds of the world.
    The processing delays mock America�s respect for those who �play by the rules� and get in line. At the same time USCIS awards 10s of thousands of greencards to people every year outside of USA based on a pick or lottery.

    At the end of 2006, there were an estimated 200,000 employment-based principals waiting for labor certification, which is the first step in the U.S. immigration process. The number of pending I-140 applications, the second step of the immigration process, stood at 50,132. This was over seven times the number in 1996. The number of employment-based principals with approved I-140 applications and unfiled or pending I-485s, or the last step in the immigration process, was 309,823, a threefold increase from a decade earlier. Overall, there were 500,040 employment-based principals (in the three main employment visa categories of EB-1, EB-2, and EB-3) waiting for legal permanent residence. And the total including family members was 1,055,084.

    These numbers are particularly troubling when you consider there are only around 120,000 visas available for skilled immigrants in the EB-1, EB-2, and EB-3 categories. To make things worse, no more than 7 percent of the visas are allocated to immigrants from any one country. So immigrants from countries with large populations like India and China have the same number of visas available (8,400) as those from Iceland and Poland.

    At the same time, a debate rages about H-1B visas and this gets considerable press coverage. Companies such as Microsoft, Intel, and Oracle have been lobbying for visas to bring in skilled immigrants, but have focused on expanding the numbers of H-1B visas available. Why? Perhaps because workers on these visas are desirable, as they are less likely to leave their employers during the decade or more they are waiting for permanent residence.

    So we want skilled immigrants, but we want them to come on the right visas as permanent residents. The battles being fought are about bringing in more people with H-1B visas�not about those who are already here with them and stranded in �immigration limbo.�

    Unlike many of the problems facing the United States, this one isn�t hard to fix. All we have to do is to increase the number of visas offered to skilled workers in the EB-1, EB-2, and EB-3 categories from 120,000 to around 300,000 per year. And we need to remove the per-country limits. Instead of requiring graduates from top universities who receive jobs from American corporations to go through the tedious H-1B visa process, we should provide a direct path to permanent residence. We are now competing with the rest of the world for the best talent. We need to do all we can to attract and keep skilled immigrants, rather than bring them here temporarily, train them, and send them home.
    One more most important aspect is also to provide an oversight over USCIS. Presently, processing delays, lost paperwork, incourteous and bad customer service and above all a non-transparent system is what immigrants face. Why should legal tax paying immigrants wait in line patiently for half a decade and pay high fees to get lousy customer service and no accountability for fees?.

    A member-driven and membership-driven organization will not have to taunt members into contributing or shaming them to contributing, imho.

    If we become verified and paying members, personal email messages can be sent out for the (less frrequent, perhaps) funding drives. A code of etiquette or something akin to it should be enforced that spells out the rules of participation in forums as well, and discourage such comments.

    You pay the basic membership - you get on board. When extra funding is required, you do what you can - there's no extra pressure or shaming anyone into contributing.

    There can be *plenty of other benefits*, and an organization sufficiently large enough can probably generate enough revenue to have at least 1 full time person on board coordinating stuff... or a bunch of volunteers and part-timers (for folks who have their EADs and are using it, this would be a chance to jump in... and help out).

    I like the idea of an annual $100 fee to join.. that way all members have contributed.

    Secondly, i think while a forum method is good, the Administrators should stop posting vitriolic messages ( For Ex: " I cannot believe people are not donating" / " you should be ashamed.." and such).. This creates a very childish image for this organization.

    If there are 25k members and your funding drive is for $30k, why don't you accept $5 and $10 donations?.. Why only $100 or above?.. With 25k members, if we start a drive to donate $1 / member and only 1 in 10 respond, you will reach your funding goal.

    Also, in the do_not _register_to_vote point, add: One should not even verbally claim that they are a US Citizen (obviously especially when you are dealing with law enforcement, state and federal agencies). If proven it would essentially strip one of the GC status, make ineligible for naturalization and all set to be in line for deportation.

    Secondly, add the point about updating the I-9 if you are employed.

    That said, with the AC21 portability, once an employee is working in the sponsor company for more than 180 days after I-485 filing (and possibly years before that) the issue of staying on with the sponsor for 6 months to 1 year is a completely moot point!

    Unless I need to show it in travel or elsewhere, I never carry my GC with me at any time, nor will I in the future until I see exceptional enforcement on this. As you mentioned there is a law on this but it letter of law is a bit debatable. There are many competent attorneys (whether correct or not) who have suggested that having it in possession at all times means that you should be able to get it easily. I have my A# in my memory and in a confidential e-mail, that would suffice.

    In the event one loses it if carried on person, who would want to get into the trouble of applying for replacement (especially when one has an impending intl. travel). Further I will do everything possible to loose least possible info (incl. A# on the GC) out to the ID theives who get hold of my wallet.

    I had H1B valid up to 2010 (3 years extension because of I-140 being approved). Then I traveled abroad and entered US last December using AP. My new I-94 said "paroled in" and had an expiry date of Dec 2008 (till the date the AP was valid). Last week my company applied for transferring my H1B to one of it's subsidiaries as my position was transferred to the new subsidiary. They applied using premium processing and got an approval this week. My new H1 is valid for the next three years now (till 2011) :)

    Also, although I entered US using AP I continued working using my old H1B. I did not use EAD. I talked to my attorney and according to them entering on AP does NOT automatically switch you to EAD. You can still keep on working on your original H1B. Since my H1B transfer was approved later I believe they are correct in this regard.

    Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?

    First of all, I am not threatening to quit IV.
    Secondly, even if I quit, its not going to matter to IV.


    IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.


    Thats why I am here. However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.


    However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question.


    I also enjoy that very same privilege. We are not here for things that we appeal to our 'taste'. This is not a forum discussing 'Borat'. We are here to talk about our interests as they relate to greencard and retrogression.


    Clearly USCIS is using one interpretation of the law while there is another possible one.


    Exactly. USCIS is using an interpretation of the law. EB-2 India doesn't like the current interpretation. EB-3 ROW doesn't like the alternate interpretaion. EB-3 India doesn't care. If you can say you don't like the current interpretation, you should be ready to hear form others that they don't like the alternate interpretation.


    The discussion here doesn't mean that IV will flip tomorrow and say they will fight for only India/China EB2s.


    Thats why I am still here. Thats why ROW-EB3 is here. And thats why India-EB3 and China EB-3 are here.

    Here is the current situation, as of Febuary 11th, 2007.
    EB-3 ROW : BaselineA
    EB-3 India : BaselineB
    EB-2 India : BaselineC

    We make efforts, and then this happens.
    Outcome 1:

    I think it should have minimal or no impact on your GC process. Somehow you can get gc. But what is the impact of case in your personal life that is more important. If you have an asset or money those are under risk. But if you have very less savings what they are going to achive by sueing you. Also did you have Insurance? Then they might put you and your Insurance company in lawsuit. Then your Insurance company may fight for you. If they win the case and court ask you to pay 1 million dollars then you can file bankruptsy protection and come out if you have very less money. Fighting is always better option than giving up. But again it is individual's decision. As you have option of going to India. But no such option for Americans


    Hi Gurus,

    I need an advice from you.

    The situation:
    -- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)

    -- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.

    So what are my options now?

    1. Check with attorney and start defending..?
    2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
    3. What about my GC?

    Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

    Just because a large number of IV members are EB2 Indians (based on the comments posted) doesn't mean that we should ignore the interest of EB3 ROW or EB3 Indian/Chinese.

    Any talk about moving visa numbers from EB3-ROW to benefit EB2-India only divides us therefore should be despised. Let's focus on the real issue (supply & demand of EB visa in general) and serves the interest of all people suffering from this.

    However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3.     I dunno about which bank is the best but I guarantee this ICICI does sucks! they act like as if they are ruling NRI. and of course like anyone else we had a very bad experience talking with their home loan dept too. Honestly - If I may say something about this....I can say this with 100% confidence that sooner or later we all will witness their demise. count on it.

    The point is that they cannot JUST do this to us(NRI) or I can say it is we who made their success if they are really. but by the sheer power of community like this - we can definitely teach them a good lesson by just quit banking with ICICI. guess what you will be proud of what you did in the very near future. SBI still IS doing reasonably well and you still can get better rates though.
