Friends,
There is a rumor going around now. One of my colleagues here claims that he got a call from his attorney that there is going to be a new bulletin for july, released either tomorrow or on Monday. Can someone talk to their attorney and confirm this?
I'm unable to reach my attorney now.
Rumors seem to be getting stronger by the hour. And all the info is coming from lawyers who are usually conservative in releasing such information.

For all those who have sent me pvt. messages, I will mail you a copy of the letter I sent out to Secretary Napolatino and first lady in the evening today.

Never mind- sometimes, no activity is actually good. I am seeing repeated LUD's on my approved 140 and now wondering what is going on.

Again today there is an LUD (10/15/2007) on the below quoted H1B petition. What is going? The status remains approval notice sent, however.
This may not be related to this issues but I saw an update of 09/25/2007 on my H1 case with a previous employer whom I left in 2004. This case was approved in 2003.

Good news but sounds too good too be true. On an average a family takes away 2.5 visas and going by this only 50,000 applications for primary bene is pending.
So if they are giving this info to Senator for free why are they asking us to pay $5K for this; unless we requested different information.

In my view H1B problem is directly related to Retrogression problem. Lets step backwards and analyze this.
Why so many GC were applied at the first place that caused retrogression. Because a large number of people came on H1B to US. All these people who came to US on H1b did not actually had any extraordinary skills. These people somehow got in touch with these Desi Consulting companies and came here without any skill and without any projects. These desi consulting companies applied there GC irrespective of the fact that these guys have a job or not. Some of the people I know have sat on bench for years, living with their relatives, unable to get any job. But they had their labour filed. These knid of people would not have made to US, if these fadudent companies were not there.
Also big companies, have a policy not to apply GC before one year of service. The point was that these companys will file GC only if they feel that the employee adds value to the company. But with these desi companys people have filed GC even before joining the companys.
In essence if the GC process was working without these Desi companies, I can bet that the number of GC applied would have been much lower than what have we currently have.
Substituted labor has further added to this problem.

I'm not writing this in my capacity as a core member, but just as a regular individual. Aman has selflessly worked towards EB immigration reform, at the cost of precious personal time with family, as well as taking vacation time in order to make the numerous trips to Washington DC. He has not asked for reimbursement for expenses incurred during numerous previous trips to DC.
The skilled professional community, those who are members of IV, and those aren't yet, must be extremely grateful to Aman for this selfless act.

If any employer is minting too much and troubling a lot, make all necessary advances that one can physically produce, in such case once the person is approved with good status of Green Card one can sue the employer, that would be the right time to bring him to justice.

It is very important to put proper subject in your e-mail. Please refer to the chennai consulate website for more information. Because of the volume of e-mails they'll be getting, they don't respond to normal e-mails. I got the response the next day. I don't know if i am a isolated case but it doesn't hurt to follow the instructions in the website.
The email response I got from consulate says following:

My case is not complicated..no issues with H1..no questions asked about my employer..just only about my spouse AOS..and I have AP, EAD which means they should have my background information already. I feel like I unnecessarily went to visa stamping. It is taking more than 2 weeks, after visa stamping, to get passport back..so going to India for 1 month vacation with visa plans is very risky..
Will let you know once i receive my passport.

Second the idea of using an ATM card for this purpose. You can get an ATM card for your parents or relatives in India from your local credit union or bank in the US.
ATM is a good idea.. What I normally do is I take or send my US check book signed of course and my name or family members name in pay to field.. No transfer fee or any thing and you can directly deposite it in any bank account with USD amount on it. The catch here is it take 10-15 business days.. but if it is not an emergency I find this is the best way and besides this you get better rate too...

I'm sure there are some intelligent and caring lawmakers somewhere who listen to legal immigrants' plight. They don't seem to be in enough or meaningful numbers. Most are interested in either keeping their seats or serving a subsection of their community.
Again, I believe they are moved mostly by lobbyists and other power groups. I don't yet fully understand how much power IV can wield, but IV could be one such group.
Lawmakers care about high-skilled immigrants only because people like B. Gates, Compete America and such keep lobbying any and all the time.
BTW, I'm not at all short-sighted about this. I'm just more realistic about how things happen in Washington. Need proof: For example, look at the staffers on McCain's campaign. Most are lobbyists. Understanding how democracy works in America and commenting about it is what the real big picture is.

Based on the original post, I infer that lawmakers won't care if they receive calls from LEGAL Aliens. If that is the logic then why do you think that lawmakers will work on "immigration" bills. After all the "immigration" bills only benefit folks who don't vote immediately. But one of lawmakers duty is to build the next generation America, and "immigration" bills benefit next generation America. People got to understand this fundamental difference and stop being pessimistic about IV efforts.
Directly talking to lawmakers office (through phone or in person) is far more effective than Web faxes and digital signatures.

I thought EB2 vs EB3 is mainly determined by what your job requires.. You may have a Masters but if your JD does not require one, the company cannot file you on EB2.

Based on my understanding once 485 is filed, one can only get one year H1b extension it does not matter if one uses EAD/AP.
Q33 If I-140 is approved, 485 pending, still 3 yrs H1-B extension possible?
A33 Yes, if you have three years left fro original 6 years. If your 6 years are over and your 485 is filed, you can get only year to year extensions of H-1.

I can think of following reasons in the order of relevence :
- We've got highest level of tolerence in the world as individuals and as society (probably that's why british could rule for 150 years :) ) and please don't shoot me, i'm not saying it's bad. just a fact.
- Feeling of insecurity because of being in a foreigner country or because of not being a part of majority.
- lack of knowledge of our rights/duties which sometimes causes guilty feeling when you think "I'm objecting to something that i agreed to whole heartedly, yesterday".
- going to court/authorities is considered bad in many culstures (as a famous Marathi saying goes "a wise man should not climb court's door-stpes ")
- "I don't have time", "I don't wan't the hassle" or "Jaane do" attitude.
- Is there anyone who still thinks along the lines of "maine aapka namak khaaya hai.." ? i don't think so.

These are small regulations that agencies can do. But even for such changes, the time period to get it done is very long (several months to a year). At least DOL woke up and acted. It will still leave a door open for sellers to stay happy and able to substitute labor. However it is not easy to find a buyer of a LC in 45 days.
All these are small problems compared to retrogression. Labor substitution rule will not get any visible or any noticeable relief to us. We will continue to stay retrogressed and wait for another 10-15 years for our greencards. It is important for us to contnue to fight to end retrogression by getting a legislative change done. As long as members are there to support IV, the organization will use every means to get relief measures for all of us. The coming months are crucial to our struggle. We need to stay united and continue the effort of making this organization a formidable force on the hill. IV members writing negative comments on various forums or feel disheartened should know that to get even a smallest job done is not easy. They are not only harming the whole effort and making anti immigrants happy, but also harming themselves by hurting this cause. Sometimes it is sad to read such negatve comments when you know how hard it is to work with limited time, resources, manpower and lack of much needed motivation in members.
BTW In our recent efforts we did give anti-immigrants shivers down their spine. It can be seen from their posts on their sites and also the hate mails they write on our forum and send to core members. You dont see a lot of it because we moderate posts. We are not scared of anyone. All this has only made our resolve stronger to fight it out and fix the system.
