    my I-485 was pending from 2001 and then my case was transfered to NBC I had an interview and then I got the I-797 Welcome Notice welcoming me as a permanent resident of the United States and it said on the notice you will get your green card in the mail in about 3 weeks and then checked my online status it said we ordered the card for production
    ok at this point everything is looking good
    and then after 5 days check my status online
    found the following :

    Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

    Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.

    We reopened this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS on November 29, 2007, and are now reviewing our earlier decision.

    Are you sick?

    Go and check how many EB3 India and EB2 India applications approved each year. They are approving double or triple the number of EB3 applications than they approve EB2. Go back to past and ask people not to apply in EB3, then only it solves your problem.

    Its all because of toooooooooo many EB3 india applications in past. So, live with that fact.


    I believe that there is a great flaw in the way the USCIS allocates VISA NUMBERS among EB1, EB2 and EB3 which is very much evident and if we can stand united we can get something done.

    After carefully observing the trend in VISA approval and VISA bulletins, It is a reality that EB3-I is not moving and at the same time EB2 and EB1 are moving fast in relative terms and probably may even become current ( EB1 is already current ), But one thing USCIS is clearly not considering is the Priority Date, which basically means that they are not giving a damn thing about how long the person from EB3-I is waiting for. Here is my suggestion and some of the IV representatives need to analyse what Iam gonna say and see if they can stand up. Being an EB3-I india myself, i totally agree that EB1 and EB2 should be given a weightage and some preference over EB3, but I dont agree to what USCIS is currently following, EB2 With priority 2006 getting ahead of EB3-I with priority date 2001. This is ridiculous and to even think about it, it just sounds stupid. What they can do is , They can move the Dates in both Categories while giving preference to EB1 and EB2 first.

    Please dont jump up & down before i complete. Iam just giving you an example of how things should work and how they can move dates forward for all 3 categories while maintaining that EB1 and EB2 gets preference over EB3. Let us ignore Eb1, since it is already current. Now Coming to Eb2, the priority Date is 2004 for them.Ideally speaking, They should not move them ahead until atleast EB3 reaches 2004. But once Both EB2 and EB3 reaches the priority date of 2004, Obviously EB2 gets the preference over Eb3 and EB2 will start to move ahead but not by much, let us say 1 year. Now, Clearly, EB2 is still given the extra preference over EB3 but at the same time, we are maintaining the priority dates between EB2 and EB3 as close as possible so that the system is not totally unfair to EB3 filers. I think, as one of the un-biased Organisation we should stand up against this unfair treatment in general. I hope even EB-2 will understand what iam trying to say.

    let me know if iam making any sense. If am wrong, also let me know. So that i can get a better understanding of things and correct myself.

    In addition to clearing the backlog and processing the 27,000 new name checks it receives each week from immigration officials, the FBI is trying to accelerate the process by making more documents electronic.     What we really need is something like what they had to do to clear the US passport backlog -- aggressive hiring and reallocation of resources to remove the backlog + reassessment of the value of examining reference files. Not a replay of the DOL BEC story OR the continuation of the current Kafka-esque situation albeit with few pieces of duct tape to show the press.

    I hope IV is making this clear in all meetings. $6M worth of changes are not going to fix the problem.

    US citizenship is a final stop for most/many immigrants. Post Sep 11, there has been a surge in nationalization applications because technically GC is like a long term visa to stay permanently. Therefore there is always a risk of losing GC because of DUI or other trivial or accidental issues etc.

    Also post Sep 11, a lot of govt/sensitive projects that were available for GC only have been restricted to US Citizens. You lose a significant chunk of the available jobs market if you are a GC holder in the Maryland/DC/North Virgina area. In fact I know a lot of GC who kept their old passports but because of these hassles eventually decided for Naturalization.


    Yes that is the one reason. Moreover i can get the Indian citizenship back by staying in India for 5 years on OCI card or PIO card. It is that simple. But Once i go back to India coming here is big problem. So I planned to take USC and Do an R2I later whenever i need or I want.

    This week i became an USC after 9 years of stay in US. I can retain USC and stay in India. Came to US in 2000. Applied GC in 2002 Jan got the green card 2003 December with EB3

    funny thing is While starting the Interview officer said " Oh you are a new immigrant" . I said I am here since year 2000. Officer replied you have just completed 5 years on Green card.

    1. How is the visa spill-over from EB1 to EB2 being distributed, are there no chances of EB3 candidates receiving a portion of it?

    2. What is the rationale for EB3 being unavailable (or moving at snail pace when available) when EB2 dates have been moved to 2006? (Please don't get me wrong, just asking questions)

    Thoughts??

    1. I don't see any chances of getting any spill overs in the next two years.

    2. There are only 3000 visas available for EB3-I in any given year (7% of EB3 quota). EB3-I will get few more if and when EB3-ROW gets current.

    Both the AILA and USCIS are playing hide and seek. Who ever shows up first, basically looses. So both are still hiding and we are loosing our sleep. :)

    I hope I am totally wrong , but if USCIS has decided to put July 2nd applications in COLD STORAGE , then July 2nd filers are in for a long & bumpy ride.I hope we don't become the rolling stone in the game between AILA & USCIS.
    What a shame? For hiding their own shortcomings , they are playing such horrible games with our future.

    NKR - Sorry, I wasn't very clear and it got misunderstood.

    What I am trying to say is that whether GC takes 1 years or 5years, it is worth the wait IMHO. If I have to do all over again knowing it could take 5-6 years, I will do it. But that's just my personal opinion.

    How are things going on your side, NKR? Good Luck.

    I am an early 2004 EB2 filer. I am hoping that mine would get approved at least before Oct. My EAD, AP, H1 and DL is getting expired in Oct. Glad to know that citizenship is making a difference in your life. I am happy for you. Good Luck

    Again, including her name on your I-485 application would not help her to "get into the queue". You need to file another I-485 for her and you can only do that if she is physically present in the US. (you need the I-94 card). You could have the court marriage in July and bring her here on an H4 or other visa, and then file for her I-485 as well.

    I am in a similar boat as you, except my ritualistic wedding would be in Aug and I am banking on the hope that the dates would still remain current for August.

    Thanks manojp4, appreciate your help. Just to clarify my doubt, she would need to file a 485 anyhow, before the dates retrogress again, right. Would it matter if I included her name in my filing, along with the marriage certificate. I guess all I am trying to understand is I know 100% that I will be married before I file, would that help her in anyway, lets say if the dates retrogress in August and she cannot file till then.

    1. Recapture lost Visa numbers- A just and reasonable demand that they cannot refuse.
    2. Remove per country cap- It is stupid to look for diversity in a category based on intellect. The whole category is created for improving America's brain power so a country cap does not make sense.

    Which is better to say" We want 10 people with OK intellect from 10 different countries of the world" or " We want 10 absolutely brilliant people-period"

    Same thing happend in my wife's case too. The status changed with a hard LUD on 04/03/09 (Friday) saying that a RFE has been issued. Again a soft LUD on 04/06/09. I guess they sent out the RFE on Monday.

    I received "Notice mailed welcoming the new permanent resident" email this evening(Sunday). The only emotion i feel right now, after being in this country for 9 years now, is relief.

    i have an EB2 140 with by current company with jan 2006 priority date.
    i tried to port priority date of my EB3 140 with my old company (Sep 2003) and that worked out finally.

    initially i sent the letter to port date in march 2009.
    I resent the letter to TSC last august. I noticed a LUD on my case after this letter on both 140s.
