This is exactly what is wrong !!! Why the hell do we feel that it is unjustified?? Not only for EB3 or EB2 or anyone for that matter ?? Congress has the authority to pass laws, even something as insane as "no EB immigration for the next 20 years" or something like that. IMMIGRATION is a priviledge, NOT a birthright. India has its laws too, my son who was born here has to report every 6 months like a criminal even though he has a valid visa in India?? Is that unjustified? NO, it is the law in INdia. Students at national universities in India from foreign countries pay in excess of 100 times what an indian student pays, is that justified ? NO, it is the discretion of the UGC.
For those complaning about USCIS, do you even remember trying to pay the water bill or the telephone bill or electric bill in INdia? Those were the reasons that drove people out of the country. The US is not perfect but it has pretty generous laws and the USCIS is not perfect but it is trying. Here, if you dont get a response in 6 months, you have options to pursue this, even talk to senators and congressmen. In INdia there are murder cases that run longer than 15-20 years.
So please cut the "suffering" and "unjustified" feelings from the equation. If you are "suffering" because of immigration related issues, then that is ENTIRELY by choice.
There will be opinions. You are entitled to yours and so am I. I guess we can lay this to rest here. No point in arguing it till the end of time.

I initiated the transfer on 19th and they delivered it today i.e 3 working days after (which is two days less than there norms). Also the rate is 43.35 today as per the calculator and they show a rate of 43.01 for my transfer. ICICI is a known thief. That is how the company is made. Its like "there is a CRIme after every successful company".

For those who are not able to put their faith in the efforts of the IV Core, too bad you didn't volunteer and participate in lobby day last September.
If you had been there, you would not suspect the motives or say things like they are taking credit for good news etc.. It is very disappointing to hear that.
I think it is reasonable that we won't be getting day-to-day updates and details on the background efforts. From my side, I have enough trust in the organization that when IV asks for the participation of the community, I will support it whole-heartedly.

Job offer has to be valid on the day petition filed or the specific date mentioned.
There is nothing cool here. Employer did mistake by charging money and candidate came to US uninvited.

Ok here is my experience,
had a hard LUD and received RFE for 325A and birth certificates,
Replied to RFE - USCIS received the mail on the 8th, same day in the evening, received a hard LUD saying, RFE response received and is under process.
Till today, I have been seeing soft LUD on our case, I dont know what is going on !!!

With total contributions < 20% (may be lower) then Payton Boggs fees (http://immigrationvoice.org/forum/showpost.php?p=50347&postcount=4) and repeated requests to focus on financial contributions, $0 contributing members continue (with utter dis-regard to financial contributions) to post in IV forums.
There is a member with $0 contributions but 241 posts (often non-english) containing utter nonsense. My dog can post 100 posts and become a senior member. However, my dog will be less shameless so as to avoid misusing someone's scarse resources.
We have 97% (of 9,000) members who can not pay $20. This is when Aman has spent 30-40K and core members have spent in K's.
The Skilled tag of IV members is only for Labor Certification. Shame on all financially non-contributing members and non-members who continue to hang here.

seekerofpeace - I hope they have not lost my file. I have not been able to get a concrete answer so far as to what is happening with my file.
My attorney had filed 140s for in EB2/EB3 and I hope they have not taken my app and classified it as EB3. We sent the EB2 I-140 with the AOS app so I dont think that would happen but stranger things have happened with USCIS.
Response that I got from the local senator and from what I read in the other thread you created, I think visa numbers are over for 2009 fiscal year. We will now have to wait until October. I dont mind waiting until October, but I want to use the next 15 days doing whatever I can, so atleast in October, I have some chance of getting approved.
Good luck to you, hope everyone who is waiting gets the good news soon.

Even look at the previous post from hope_4_best. They paid everything for a claim, except of course, the deductible and coinsurance. Also, look at the experience from jgs_res, they paid in his case also. Therefore, it seems that they have a good history of paying the eligible claims.

As the guy who posted it said, this is a normal process....Consulates will know 3 to 4 days before...
That is correct, 9 months and then I will return to my country for good.
I am waiting for the day when we get the GC , we will tear it into pieces and throw in front of consulate.

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. The only chance that it happens is that visa overflow from other categories into EB2China/India...For that to happen..Eb3 world has to become current.....
That would mean that more visa are available than can be used for Rest of world...Then CHINA/India would get some more than 7% country quota....
So it could be Oct 07 or if you are lucky... earlier....
If immigration reform happens..you would definately become current immedialtely...

If they keep the ON HOLD status for more than 45 days... That event is again a potential lawsuit material.... Because they are changing a Long standing practice which requires lawmaking ( ref: Rajiv Khanna's quote)

On the other hand USCIS is not doing that because they knows this weakness of AILA and trying to keep things stretching so that when OCT arrives this whole move will get weakened .... As soon as new bulletin with some availability comes out peoples will start losing motivation ...

Sadly, your ambitions are noble, but its a cruel world out there ... we can give a guestimate ... but no estimate ....and that too just to throw off the other side either way ... either to think that we are way ahead or to think that we are waaaaaaay behind ..... let them wrack their brains and use a calculator and some of their not-so-cheap-labor-math skills to find out where we are at for a change

Frankly our opponents pump in millions of dollars into their effort. Maybe one of these days we can compete with them monetarily. But all I know is they can get millions of dollars but not 25000 committed members.
Hence IMHO we disclose our goals. We disclose our costs up front. We have nothing to hide.
