I have a problem where my "Given Name" is entered as "<first name> <last name>" in my passport (India). The "Surname" is left blank. I have been in the US for 7 years now and it has never been a problem so far. I usually enter the "<last name>" in the last name column on all documents. I wonder if this will cause problems during the I485 name check stage. Any one here who can throw some light on this issue?
I realize that the question is a little weird, I appreciate any response.

I had the same issue and I got it changed from Indian consulate NY. The whole process took around a week. You need to advertise in local newspapers which is not a big deal. Around Rs 200 in indian newpaper and $70 in US newspaper (Classified section).

Even if 1000 of our ~41000 members contribute 100 dollars each, we can host two more events like this.
It makes sense to ask help from outside of the organization only when our internal resources are all exhausted. However, sadly, most of us do not want to even contribute for the good cause. :o
We can also ask some big companies like Microsoft who back legal immigration extensively to help us financially right?

Look on page 10 and this number is only with the leading occupations. There may be others like auditors.
Note: Occupations with a salary greater that 60k are EB2 95% of the time.
I think comparing both these data I can approximately say 90,000-100,1000 EB2 labors have been cleared in 2004 and 2005. That is like 2 lakhs applicants including primary and derivative applicants. Even if we put a 50% error margin thinking that there were more Eb3 labors, 140's are denied or downgraded to EB3 or a problem at 485 stage there are 1lakh - 485 applicants including Eb2 and EB3 waiting for 2004 and 2005. With a per country quota of 3800 + a bit of row how many years will it take to come to 2006 - where a lot of Eb2's are stuck?
I think it will take 10 years for a EB2 2006 applicant to get his physical green card including 485 waiting time etc.

I agree with you totally on this chanduv23.
Doing things legal ways is just fine in most cases. But there are some times when you need to decide and treat people in a humane way.
A saying goes. "Headache pains are known to only those who have it and suffer." Somebody was arguing that scientifically delivery is just a natural phenomenon. But the pains and trauma can only be felt by a woman who delivers and there are circumstances when you are forced to be in shackes during delivery.
Hope this sensitive thread does not divide the IV community.

WHat I have noticed is, everyone has their own opinion and stay entitled to their opinion. Everyone wants to be judgemental through their opinion.
Now, lets all for a moment - step out of our "legal immigrant" shoes and step into the shoes of someone who has to decide what to do? As a decision maker, what will you do? Everyone has their own opinion to which they are entitled and thats whats happening.
Now, ocne again - step out of your legal immigrant shoes, and say, for some reason, you lost status and are deportable - what will be your opinion? Would you say "Shakle me and put me in detention center?"
If you are in poverty and and have no food for 2 days, you may go grab a bread from a store and run to a safe place and eat it - will you talk all these rules about shop lifting .....
If you catch a hungry child shoplifting to eat a bread will you PUNISH him? Ir will you try to do someting to make things better for him?
All you have to do is to come out of "the hate and hard" thinking and try to look at things in "rational and meaningful way"
Hate no one for what they are or how they are. Try to see if you can help. Just help.

Forming so many sub groups, promoting caste feelings, fighting each other, trying to piut down other fellow community members, lack of unity and what not ....

1).I came to USA on L1-B in 2003 October and the I-94 was till september-2006.
2). Then i changed my Visa to H1-B in 2005.
3). I was asking my employer to file for change of status from L-1 to H-1.
4). Those guys filed for a new H-1 and sent it to a consulate in India.
5). I was not aware of this and i thought i am legal till september the expiration date on my Visa.
6). Labor got cleared in July-2007.
7). Thought i would file for I-140 and I-485 together and found out that my I-94 was expired since September-2006.
What is the best course of action here to remedy my situation??
Any advice or details of a great Immigration lawyer who dealth with such cases before would be of great help.

yes..totally agree...it might cost around 1000$ but I think ppl shud take attorney..I felt the same after the interview.
I had every damn document for the last 6 years..every paycheck..all 94's..all empl..letters..
I felt it was a clean case..but you never know.

Well having attorney will help AC21 cases also. Who knows how limited knowledge has regarding AC21 and all the latest memo associated with it. Even if they have some knowledge they may try to impose a different interpretation of that on you during the interview.

We are really thankful for your contributions. Let me remind all the members here, every penny you are paying to IV is accounted for. All the expenses incurred by IV members for traveling to DC for various meetings are all non-billable and are borne by themselves. There are few core team members whose personnel expenses have gone beyond 10K. I believe each of you can very well understand their need for green card is no more or less than your need for the status. So everybody, I repeat, everybody, please come forward and contribute.

I also looked around for subLC, could not get one and had the same state of mind. I was not willing to take risk for it, like leaving my current job etc. so I know first hand the exact state of mind.
regarding ur post: the point u r missing is the lcSUB was legal till middle of july 2007. It is not any more. At this point, it is like crying over something which is stopped 2 years back.
if you think from a balanced mind, that "visa recapture" and "end of discrimiation based on country of birth" can end woos to all of us.
As far as your argument for under representated countries, yes they do have visa lotterry and for your kind knowledge, india is not listed for this.
Lastly, would appreciate if you can update your profile and make some educated arguments.

My lawyer applied for my visa an 23rd Apr under the masters cap. I haven't received The receipt yet. I am wondering if there is anyone on the similar lines. Please reply or is it only me with one such case. I know USCIS has said that they need till 2nd June to resolve the situation. My case is with the vermont center.
I also have my OPT case pending there. It was filed in the first week of May. I have been told that it takes around 90 days for it but sometimes it also takes place early. Please advise.

Sad, but true, the substitution labor are utilizing the visa numbers a lot.. Not sure if any thing can be done @ this time.... There were lots of new people filed I-140/I-485 utilizing substitution labor in July / Aug 07 as the LC substitution was sunset after wards... Though it is legal :confused: they could have made the PD, they day I-140 was filed, since they allow to retain original PD, now people who really waited are forced to wait even longer.... Now that the program is sunset and also many people already jumped the line, do not see any advantage in complaining about it and expect no administrative reaction to this as labor sub no longer exist... Only solution to retro... is unused visa recapture / increase visa number / exclude dependent / etc... none of these can happen without intervention from congress.... which required very intense lobbying... which in turn requires $$$$ ... and more participation and contribution from the members seems to be the only option that could help all... If you don't help yourself.. no one would !!!

What is happening to Biharis in Maharashtra...are Biharis not Citizens of India.....we don;t even tolerate people of other states, coming to our state!! and expect US to just keep letting trespassers in?

The overwhelming majority of posters sympathized with the women and were uncomfortable with what the sheriff did.

Hi,
We filed for my wife's H-1B under Masters Quota on April 30th and sent the application packet to Vermont Service Center. But on May 3rd UCSIS sent back the packet which we received on May 11th. They also sent a letter saying that the application be sent to Laguna Niguel (CA Service Center) instead.
Do you know if we can resend the application to Laguna Niguel now -- i.e., after the H-1B Master Cap is reached? If we can, then from which H-1B pool will USCIS issue the H-1B approval?
Has this happened to anyone before?
